스토아 자연법과 키케로의 자연법 이론

초록
키케로는 스토아학파의 자연법 사상가로 알려져 왔다. 그러나 키케로가 스토아학파 소속이라는 것은 정확하지 않다. 아테네에서 제논에 의해 창시된 스토아학파는 아카데미아 학파, 소요학파, 그리고 에피쿠로스학파와 경쟁하면서 철학상 여러 주제에 대해 논쟁했다. 스토아학파로 현대인들이 주로 기억하는 것은 세네카와 아우렐리우스 황제 같은 후기의 사상가이다. 하지만 초기부터 후기까지 어느 한 사상가가 스토아학파를 대표한다고 할 수 없을 정도로 여러 스펙트럼이 존재한다. 이처럼 스토아학파의 사상이 단일하지 않으므로 키케로가 말한 것이 스토아학파의 견해라고 하여 양자를 동일시하는 것은 방법상으로 옳지 않다. 하지만 그의 자연법사상은 스토아학파의 영향을 받은 것으로 널리 인정되고 있다. 본 논문의 목적은 키케로가 신아카데미학파의 인물임에도 왜 스토아학파의 자연법 이론을 수용했는지 살펴보려는 것이다. 본 논문은 먼저 아테네에서 출발한 스토아학파의 초기 사상을 요약했다. 이어 기원전 155년 카르네아데스가 로마 원로원에서 정의에 관해 연설한 것이 로마 지도층에 큰 영향을 미쳤으며, 그 이후 스토아 자연법사상의 로마화가 일어났다는 점을 설명했다. 그리고 키케로의 저술에 나타난 자연법사상을 로마화한 스토아 자연법사상으로 로마의 팽창적 대외정책을 정당화하는 시도로 보았다. 또한 키케로의 자연법사상은 로마 공화국의 법을 보편적 자연법의 구현으로 이해한 점에서 자연법에 실정성을 포함했고, 그런 점에서 초기 아테네 스토아학파의 자연법 이론이 가진 이상주의적 성격과 구분된다고 보았다.
Abstract
Cicero is well-known for the natural law theory of Stoics. However, this is not accurate. The Stoics, founded in Athens by Xeno of Citium, produced many competent disciples over the centuries. They competed with the New Academy, the Peripatetic, and the Epicureans. In particular, Stoics are not monolithic. It is methodically incorrect to equate what Cicero said with Stoicism. This article aims to examine why Cicero accepted the natural law theory of the Stoics. It first summarized the ideas of the early Stoics that originated in Athens and explained that the speech on justice by Carneades at the Roman Senate in 155 BC exerted influence on Roman republican leaders and that the romanization of Athenian Stoic natural law theory has since occurred. It explained that the natural law theory in Cicero's writings is romanized thoughts and attempts to justify Rome's expansionary foreign policy. In addition, Cicero's natural law theory included proponents of actual Legislation of natural law in which he understood the laws of the Roman Republic as a realization of universal natural law. In this regard, it differed from the idealistic nature of the natural law theory of the early Athenian Stoics.
