산업안전보건법에 따른 건설 계약자의 행정 및 형사 책임

The purpose of this paper is to identify the problems of these completely revised Occupational Safety and Health Act(OSHA), and draw improvements by comparing them with the cases of developed countries. OSHA is a labor protection law that guarantees protection from risks to life and health of workers through state supervision and sanctions, not workers' demands, and compels workers to follow instructions and orders under the law. Focusing on the revised OSHA, the author proposes that the administrative and criminal responsibilities of contractors in the construction sector were compared with those of advanced countries, and meaningful implications were drawn accordingly. The author suggests that some academical and practical implications are as follows. First, although the purpose of amending the law is good in the revision of OSHA, there may be many problems in interpretation and application of the law, so the name and definition should be renewed. Second, it is necessary to revise the comprehensive evaluation and bid system in the directin of increasing the proportion of construction safety among social responsibility field to enhance the safety management effect of construction companies. Third, the legal application of construction contractors should be strengthened in the revised OSHA like a advanced countries’OSHA.
