프랑스 국립대학 총장 선출에 관한 연구 - 법률 및 주요 국립대학 정관을 중심으로 -

초록
대학 자치는 대학의 학사, 인사, 재정 및 관리 등과 관련하여 대학 스스로의 결정을 보장받는 것으로 여기에는 대학 내부 의사결정의 자율성 및 대학이 외부 간섭으로부터 영향을 받지 않고 스스로 제정한 규범에 근거하여 운영할 수 있는 독립성이 포함되어 있다. 그리고 이러한 대학 자치의 핵심에는 총장이라는 구성요소가 자리 잡고 있으며, 이에 총장선거는 대학 자치에 있어서 매우 중요하다고 할 수 있다. 프랑스 경우에 교육법전에 국립대 총장선출 자격, 방법 및 총장을 선출할 권한을 갖는 관리평의회 구성원의 수를 명확하게 규정하고 있으며, 각 주요 대학은 이 법률에 따라 정관에 총장 후보 자격 등을 비롯한 관리평의회 구성원에 대한 세부적인 내용을 규정하여 우리나라와 같은 문제를 사전에 예방하고 있다. 그러나 프랑스의 이러한 제도를 우리나라가 여과 없이 받아들이기에는 다소 무리가 있다고 판단된다. 첫째, 프랑스의 대학교육은 공교육을 기본으로 하고 있으며, 둘째, 프랑스의 고등교육 제도는 우리나라와 근본적으로 차이가 있기 때문이다. 또한, 총장을 선출할 수 있는 관리평의회 의원의 구성도 우리나라 개정 교육공무원법에는 존재하지 않는 외부인원을 25%정도 참여시키고 있기 때문이다. 하지만 차후 우리나라 국립대학 총장선거 방식(각 주체들의 투표반영비율) 합의 시 프랑스의 관리평의회 구성 비율은 참고가 될 수 있을 것으로 생각된다.
Abstract
The autonomy of the university is to ensure the university's own decisions on the academic, personal, financial and administrative matters of the university. This includes autonomy in decision-making within the university and the independence that the university can operate on the basis of its own established standards without being influenced by external interference. And at the heart of academic autonomy is the president's component, and therefore the election of the president can be considered very important for academic autonomy. In the case of France, the Code of Education clearly specifies the qualifications and procedures for the election of the president of a national university and the number of members of the Governing Council having jurisdiction to elect the president. However, it is considered somewhat unreasonable for Korea to accept the French system without filtration.
