일본 임상법학교육의 현황과 시사점

초록
일본은 2004년 법과대학원 제도를 도입하여 74개 학교가 출범했고 39개 학교에서 실제 사건을 다루는 리걸클리닉을 운영하였지만 현재 신입생을 모집하는 곳은 33개에 불과하여 법과대학원 제도 자체가 축소되고 있는 추세이다. 또한 법과대학원에서는 법학부 졸업생을 대상으로 한 2년 코스의 비중이 높아지고 법과대학원 재학 중 사법시험의 응시가 가능하게 되었다. 이러한 현실적인 어려움 속에서도 와세다 대학 법과대학원은 20여년 동안 임상법학교육을 위한 부설 법무법인을 운영하고 있고 연구자 교원과 법무법인의 변호사가 협업하여 리걸클리닉 수업을 꾸준히 유지하고 있다. 일본의 임상법학교육에서 대표적으로 참고할 만한 것은 실제 사건을 수임하는 대학 부설 법률사무소를 운영한다는 것이다. 법과대학원 제도 자체의 축소로 인하여 부설 법률사무소 운영도 축소되고 있지만, 와세다 대학의 사례와 도쿄변호사회의 공설 법률사무소의 사례는 참고할 만하다. 아울러 임상법학교육을 위한 연구와 교육 방법 교류를 위해 학술지를 발간하고 국내외 네트워크 활동으로 연례 심포지엄을 개최하고 있는 임상법학교육학회의 활동과, 법률구조 활동을 중심으로 변호사회와 협력하는 것은 우리 법학전문대학원에서도 실천해 볼 수 있을 것이다. 일본과 우리나라에서 공통적으로 사법시험(변호사시험) 합격률이 당면 과제가 되고 있지만 현장 실무 경험을 통한 법학 교육과 사회공헌의 기회를 제공하는 임상법학교육을 위한 노력은 지속해야할 것이며, 우리나라와 유사한 법조인 양성 제도 속에서 여러 문제점을 극복하기 위한 시도를 하고 있는 일본의 임상법학교육에 관심을 가지고 교류를 지속할 필요가 있을 것이다.
Abstract
In Japan, 74 law schools opened around the country between 2004 and 2005. 39 law schools operated legal clinics, but only 33 law schools currently recruited new students, and most law schools can not fill the student quota. In the law school, the proportion of the two-year course increased, and it became possible to take the bar exam while attending law school. In spite of these problems, Waseda Law School has been operating an affiliated law firm for clinical law education for more than 20 years, and professors and lawyers have collaborated to practice legal clinic classes. The characteristic of clinical legal education in Japanese law schools is to operate law firms that practice cases with students. Although the number of the law firms in Japan is decreasing, Korean law schools can refer to operation of Waseda lawschool legal clinic and Sibuya Civic law firm(public law office) of Tokyo Bar Association. In addition, Korean law schools will be able to publish journals and hold symposiums for networks of clinical law education officials like the Japan Clinical Legal Education Association. And each law school can engage law school students in legal aid and public interest programs in cooperation with the Bar Associations. Although Law schools in Korea and Japan have common challenges such as low bar pass rate, the law schools need to continue expanding their clinical legal education programs.
