하이에크(F. A. Hayek)의 실정법의 토대로서의 ‘정의감’에 대한 고찰

초록
필자는 하이에크의 ‘정의감’에 관한 메를로-퐁티의 ‘살’적 해석을 통해서 하이에크의 ‘정의감’에 관한 철학적 해명을 진행하였다. 실정법의 토대로서 ‘정의감’이라는 실천지의 제시는 실정법의 실존적 규범성을 위한 새로운 발견이라고 할 수 있다. 하지만 그의 ‘정의감’은 여전히 현상적 기술에 머물러 있기 때문에, 실정법의 토대로서 ‘정의감’의 보편주의적 타당성은 여전히 불충분한 상태에 놓여있다. 물론, ‘정의감’의 일반적 공유성이라는 현상적 속성이 어느 정도 ‘정의감’에 관한 보편주의적 타당성을 제공하지만, 여전히 ‘정의감’에 관한 주관주의적이고 상대주의적인 의심을 완전히 벗어났다고 말할 수는 없다. 이런 맥락에서 ‘정의감’에 관한 ‘살’적 해석은 실정법의 토대로서의 ‘정의감’에 관한 철학적 해명을 제공한다. 이를 정리하면, 첫째, ‘정의감’이 형성되는 형식인 모방에 대한 철학적 고찰이다. 여기서는 어떻게 ‘정의감’이 형성되는 지에 관한 철학적 규명, 즉 모방이라는 형식이 가지는 가치나 의미생성의 역학에 관한 철학적 고찰이다. ‘정의감’의 형성의 방식인 모방은 실은 ‘살’의 이중적 운동성에 관한 현상적 기술에 불과하다. 둘째, ‘정의감’의 경험적 혹은 현상적 속성인 일반적 공유성에 관한 철학적 해명이다. 여기서는 왜 ‘정의감’이 일반적 공유성이라는 현상적 속성을 가지는 지에 대해서 고찰한다. ‘정의감’의 현상적 속성인 일반적 공유성은 ‘살’적 운동에 의한 나와 타자 간의 상호맞물림에 의해서 형성되는 ‘상호신체성’에 다름 아니다.
Abstract
The article is to aim to study Hayek’s rechtsgefuhl on the basis of Merleau-Ponty’s flesh. Though rechtsgefuhl as the basis of law is new discovery for the existential normativity of lawfoudation, His rechtsgefuhl end up to phenomenal description. The phenomenal attribute such as the general sharing of rechtsgefuhl provides his rechtsgefuhl universal validity, but his rechtsgefuhl is put in subjective and relative doubt. In this context, flesh’s interpretation on rechtsgefuhl provides the rechtsgefuhl‘ philosophical explanation. First is the philosophical explanation about how rechtsgefuhl is formed. The imitation as the method that forms rechtsgefuhl is only the phenomenal description for flesh’s double moving. Second is the philosophical explanation about the phenomenal attribute such as the general sharing of rechtsgefuhl. the phenomenal attribute such as the general sharing of rechtsgefuhl is based on intercorporeity formed by flesh’s moving Through such philosophical explanation, Hayek’s rechtsgefuhl has the universal validity on moral question such as equality with others. The rechtsgefuhl as intercorporeity is based on reciprocity which human being has. In the point that the other’s life naturally and directly enter my life, and influence my life, The rechtsgefuhl as intercorporeity is based on love and consideration.
