공간정보데이터와 저작권법의 제문제

Geospatial information has been widely used as information for map and building management. Recently, as many services are provided in the virtual world, such as metaverse, it is widely used in digital twins, smart cities, virtual reality, artificial intelligence, and automobile driving using spatial information. Existing studies on such spatial information looked at location infor- mation, orthographic images, and aerial photos individually, and discussed whether or not copyright was violated. However, these individual analyzes do not fully understand the nature of spatial information. This is because 3D stereoscopic information using location infor- mation, orthographic images, aerial photos, etc. included in spatial information is used, and indoor information also uses a lot of information. Such spatial information may correspond to design drawings of architectural works as a whole. However, in accordance with the fair use regulations regarding artistic works, including architectural works, the three-dimensional expression of architectural works using spatial information in the virtual world does not infringe copyright. In addition, there may be a problem of infringement of the rights of database creators, which is also difficult to see as infringement under the legal policy. Such legal interpretation theory is expected to have a positive impact on the architectural works of virtual worlds and services of virtual worlds.
