A smart city uses information and communication technology(ICT) to improve operational efficiency, share information with the public and provide a better quality of government service and citizen welfare. One emerging technology that is becoming more important for smart cities is Facial Recognition Technology(FRT). Both public and private sector organizations can enhance operational productivity and improve public safety by integrating FRT capabilities. It compares an individual’s face presented at the point of access to a database of authorised persons to determine whether there is a match. And it is helpful for vulnerable citizens. However, Act On The Promotion Of Smart City Development And Industry does not have any special regulations on personal information Protecrtion. This paper: ⑴ provides an overview the legal systems for facial recognition. ⑵ highlights concerns arising from merits and demerits of the facial recognition information and from its potential impacts on citizen’s consent rights ⑶ takes stock of the legal improvememt, especially Personal Information Protection Act and Act On The Promotion Of Smart City Development And Industry currently applicable to facial recognition. ⑷ Raise the issue of legal bases to ground the processing of personal data in smart city, This issue is crucial, as the need to have an appropriate legal basis for the processing is essential to ensure a facial recognition’s legality. It is essential that obtain consent in the smart city, given that data collection happens in a public space and is not freely given. How consent can be used in the smart city, and what other legal bases can be used instead of consent. It gives citizens more control over their personal data as facial recognition and the ability to opt out at any time. These rules will put in place much better safeguards and rights for citizens.
