플랫폼 노동 입법 논의의 성과와 과제

초록
“플랫폼”이란 알고리즘 방식으로 조율되는 거래를 통해 재화와 용역(노동)이 교환되는 구조화된 디지털 공간을 뜻하고, “플랫폼 노동”이란 플랫폼을 기반으로 이루어지는 노무 제공 관계라 할 수 있다. 이 글은 알고리즘과 노동법적 규율 기준인 종속성과의 관련성을 살펴보고, 노동법이 노동을 규율하는 종속성 기준에 따라 플랫폼 노동 법제를 검토한다. 먼저, 근로기준법 및 노동조합법상 근로자 법리가 플랫폼 노동 영역에서 어떻게 적용되고 이행을 확보할 수 있는지, 그리고 플랫폼 종사자에 대한 사회보험 입법 결과 및 현재 진행 중인 노동시장 관련 입법 논의 등을 살펴본다. 나아가 최근 진행된 플랫폼 종사자 보호 입법과 관련된 쟁점을 검토한다. 플랫폼 노동은 노동법의 경계를 확대하고 전통적인 규율 및 이행 방식의 변화를 이끌고 있다. 플랫폼 노동은 노동법이 그 경계를 확대하는 계기가 될 수 있다. 그와 함께 노동법은, 알고리즘이라는 플랫폼 노동의 새로운 통제 방식으로 인해 그 이행을 담보하기 위한 법리 등을 새로 모색해야 하는 과제에 직면해 있다.
Abstract
‘Platform’ refers to a structured digital space in which goods and services are exchanged through transactions coordinated by algorithmic methods. ‘Platform labor’ could be said to be a labor provision relationship mediated by the platform. Since platform labor also has the characters of ‘labor’, it should be regulated in the same way as the labor legislation system. Algorithmic management or control in platform labor is related to the subordinacy standard of labor law. Based on the above perspective, this article reviews the applicability of employee case law to platform labor, the results of social insurance legislation for platform workers, and the ongoing discussion of platform labor market law. It also reviews legal issues related to the Platform Workers Protection Act. Platform labor could be an opportunity for labor law to expand its boundaries. And, the labor law is faced with the task of finding new means to ensure its implementation due to the control methods of platform labor called algorithms.
