상가건물임대차보호법상의 권리금에 관한 연구 : 순천시의 사례를 중심으로

Although the store premium is transferred between the former tenant and the new tenant, it is common for disputes to arise between the lessor and the lessee. There are several reasons other than interference from the lessor that the lessee is not guaranteed the right to pay. Nevertheless, the current Commercial Building Lease Protection Act stipulates only the reasons that can be disturbed by the lessor, and even that, the exemption provisions are confusing, causing confusion not only for the lessee but also for the lessor. Do the lessor and lessee have no choice but to conflict with respect to the the store premium system? In this paper, in order to solve the doubts, I met, interviewed, and organized the merchants in the Suncheon area, which is a local community. I inquired about the opinions of actual legal users on the newly introduced entitlement system, and collected opinions on the currently introduced the store premium system. This is because it is thought that examining the legal feelings of merchants who are actual users of this law and discussing countermeasures accordingly will be a means to increase the effectiveness of the law. The resolution of the dispute over the store premium will play an important role in quelling the confusion in the commercial rental market caused by continuous disputes between the lessor and the lessee and promoting social cohesion.
