한국 푸드뱅크 사업의 발전에 대한 법제적 접근 : <식품등 기부 활성화에 관한 법률>을 중심으로

This study is intended to analyze the legal system in Korea for development of the nation’s food banks, focusing on Act on Encouraging the Donation of Food, etc., which has received conflicting opinions; that it could contribute to quantitative growth and that it could be an obstacle to qualitative growth in the food bank business, and presents suggestions for improving it. For this, the study investigated the characteristics and limitations of the business of providing donated food, etc. along with the provisions related to the definition of the Act on Encouraging the Donation of Food, etc., business of providing donated food, food donation activating policy, national support, investigation of actual conditions of Act on Encouraging the Donation of Food, etc. The analysis suggests that the Act needs to be systemic by establishing separate chapters for business of providing donated food, etc., clarify the definitions of donated food providing business, donors and business operators, improve the current reporting system, which is arbitrary, to prevent the quality of operation from deteriorating, adopt a system of designating local support centers for donated food, etc., and establish a system for regular national investigation regarding actual conditions of those involved. Improvement in these areas is expected to contribute to improving the business of providing donated food, etc. in terms of its nature of being public service, responsibility, transparency and expertise.
