성범죄 전담법인을 통해 본 성폭력 사건 해결의 ‘법시장화’ 분석

This article analyzes the ‘marketization of legal practices’ in the process of sexual violence response and recovery(R&R), focusing on the tactics used by law firms specialized in sex crime defense and associated online communities to help offenders in criminal investigations and court proceedings. Law firms have created multiple mitigating factors to reduce sex offenders’ sentences. The court’s approval of these mitigating factors helps expand the law firm’s engagement. The online communities run by these firms reinforce the solidarity of the offenders by exchanging and trading information that will be helpful in the investigation and court. The assistance of such experts in various domains forms cartels by extending the supporting market of sexual violence offenders. It assists in the offender’s development of decriminalized masculinity and transforms the legal case of sexual violence into an economic one. Meanwhile, the field of the political struggle of sexual violence R&R is marred by the marketization of legal practices, which reduces it to a capital-induced victory and loss while removing a public concern for ethics and social responsibility. The article emphasizes that the field of R&R needs to be re-examined by ‘the political’ to rebuild the publicness of feminist politics in opposition to neoliberal governmentality.
