사이버범죄와 형사관할권에 관한 고찰

인터넷 시대의 가 상 공간 에는 물리적인 국경이 존재하지 않으며(borderless territory), 제한 없는 접근성(unlimited access), 편재성(ubiquitous), 즉시성 (spontaneous)을 특성으로 한다. 이러한 사이버 공간의 범죄에 어느 나라가 재판권 또는 관할권을 갖는 것인가, 법집행은 어떻게 할 것인가 등 다양한 문제가 발생한다. 소극적 속인주의나 범죄의 결과발생지도 범죄지로 해석하는 속지주의 원칙 등 전통적인 국가관할권에 관한 원칙들을 사이버범죄에 적용하는 경우 웹사이트에 접속가능한 모든 국가가 관할권을 가질 수도 있다는 결론이 되어 결국 관할권의 경합이 발생한 다. 따라서, 사이버 공간의 관할권 문제는 사이버 공간의 특수성을 반영한 고유한 규칙이나 법리를 통하여 해결하는 방안도 생각해 보아야 할 것이다. 본 논문에서는 사이버공간에서 발생하는 범죄에 대한 형사관할권 문제와 관련하여 전통적인 관할권 이론을 적용하여 해결하는 방안을 검토하고, 새로이 등장하는 사이버범죄에 대한 관할권이론을 검토하였다. 또한 사이버범죄의 수사를 위한 디지털 증거의 역외 압수·수색 문제가 등장하고 있으므로, 역외 디지털 증거수집에 필요한 형사재판관할권의 문제도 함께 검토하였다. 더불어 국제공조의 필요성과 사이버범죄 협약의 가입의 필요성도 제기하였다.
Abstract
Characteristics of cyberspace are borderless territor y, unlimited access, ubiquitous and and spontaneous. Various issues arise in the cyberspace, such as which countr y has jurisdiction over crimes in cyberspace and how to enforce the law. When the traditional national jurisdictional principles are applied to cybercrime, it is concluded that all countries accessible to websites may have jurisdiction. Therefore, it is necessary to think about how to solve the jurisdictional problem in cyberspace through unique rules or legal principles that reflect the characteristics of cyberspace. In this paper, the author reviewed the solution to the problem of crimina l ju risdiction for crimes in cyberspace by applying the traditional jurisdiction theory, and reviewed the emerging jurisdiction theories for cybercrime. In addition, the issue of criminal jurisdiction regarding extraterritorial search and seizure for digital evidence was also reviewed. The necessity of international cooperation and the need to join the Cybercrime Convention were also raised.
