초기업별 교섭 촉진을 위한 단체교섭 법제도 개선 방안

Today, our society is experiencing problems of inequality and polarization in various areas. In labor, inequality is evaluated to be mainly due to the wage gap according to the size of the company. To respond to this, it is suggested to expand the union organization rate, industry-wide or sectoral collective bargaining, and the scope of application of collective agreements. Article 30, Paragraph 3 of the Trade Union and Labor Relations Adjustment Act stipulates that the state and local governments should support labor relations parties to voluntarily choose various bargaining methods, such as bargaining by company, industry, and region, and collective bargaining is activated. Therefore, the state needs to support the revitalization of industry-wide or sectoral collective bargaining. This article examines changes in the interpretation theory of collective bargaining rights as subjective rights and changes in the normative environment for the collective bargaining system, such as the recent ratification of ILO Convention No. 98. Based on these, specific measures to improve the legal system to promote industry-wide or sectoral bargaining is reviewed. Specifically, the feasibility of the bargaining unit decision system for industry-wide or sectoral collective bargaining and the collective agreement extension system for industry-wide or sectoral collective bargaining agreements are reviewed.
