FTA의 전자상거래 조항에 대한 향후 개선 방향

Cross-border e-commerce is growing steadily, and under the no progress of discussion on the cross-border e-commerce through the international organizations, an increasing number of free trade agreements (FTAs) have incorporated specific provisions related to e-commerce. FTAs have diverse e-commerce provisions, so we need common rules on cross-border e-commerce to produce mutually beneficial outcomes. Common rules on cross-border e-commerce comprise binding obligations provisions(customs duties moratorium on electronic transmission, electronic authentication and electronic signature, online consumer protection, personal information protection, paperless trading, unsolicited electronic communication.), cooperation provisions(cross-border transfer of information by electronic means, location of computing facilities, cybersecurity, third party liability of interactive computer services(ICS), source code, cooperation, domestic legal framework governing electronic transactions), and other related provisions. For the unified and stable settlement of cross-border e-commerce provisions in FTA, steady efforts from the government and related companies are needed to effectively respond to future FTA negotiations and revisions of already concluded FTA negotiations.
