화상디자인의 일본 의장법상 개정 연혁 및 평가에 관한 고찰

화상디자인의 보호에 관하여 우리나라와 일본은 거의 비슷한 제도를 가지고 있다. 우리나라의 화상디자인보호제도는 일본 의장법상 제도를 따른 것이라고 볼 수 있는데, 화상디자인에 관하여 일본 의장법상의 개정 연혁과 그 입법취지 및 일본 내에서의 이에대한 평가 등을 제대로 살피지 않고 일본의 화상의장제도를 거의 그대로 도입함으로써우리나라의 기존의 보호시스템과 맞지 않는 모습을 보이고 있다. 이에 관한 문제점 등을 정확하게 분석하기 위해서는 일본 의장법상 화상디자인에 관한 개정 연혁을 구체적으로 검토하여 우리나라의 제도와의 근본적인 차이점을 우선적으로 이해할 필요가 있다. 그리고 일본 현행 의장법상 화상디자인에 관한 평가와 문제 제기 등도 구체적으로 살펴보아 우리나라의 화상디자인제도에 관하여 예상될 수 있는 문제점에 대해서도 미리 검토해볼 필요가 있을 것이다. 이에 관하여 이 논문에서는 현행 일본 의장법 시행 이전의 의장법 및 일본 의장심사 기준의 개정 연혁에 관하여 검토하며, 이러한 개정 과정에서 제기되었던 개정 이전의화상 관련 의장의 보호상황에 대한 여러 가지 문제점들을 통해 현행 의장법의 개정 배경에 대해 살펴서 일본 화상의장제도의 특유의 발전과정을 구체적으로 검토한다. 다음으로 이 논문에서는 현행 의장법 및 의장심사기준에 관한 검토를 하는데, 일본 의장제도소위원회에서의 주요 논의 내용을 중심으로 현행 의장법상 화상의장제도의 개정 취지및 배경을 살펴보고, 현행 개정 의장법상 보호대상 및 신규성 등의 등록요건과 의장의유사판단에 대해서 구체적인 내용과 이에 관한 주요 쟁점들을 검토한다. 마지막으로 현행 화상의장제도에 대한 일본 내에서의 평가를 통해 이에 관하여 제기되는 여러 가지 문제점들에 대해서 살펴본 후, 우리나라의 디자인보호시스템에 맞는 부분들에 관한 검토의 필요성을 언급하고 이와 관련된 화상디자인제도의 바람직한 운영방안을 제안한다.
Abstract
Regarding the protection of image design, Korea and Japan have almost similar systems. Korea’s protection system of image design is based on the system of the Design Act of Japan, but it does not appear to be suitable for Korea’s existing protection system by introducing the Japanese system of image design without properly examining the history of revision of image design in the Design Act of Japan, its legislative purpose, and its evaluation in Japan. In order to accurately analyze the problems on that situation, It is necessary to first understand the fundamental differences from Korean system by reviewing the history of revision of image design under the Design Act of Japan in detail. In addition, it is necessary to review in detail the evaluation of image design and problems raised under the current Design Act of Japan, and to examine possible problems related to Korean system of image design in advance. In this regard, this paper reviews the history of revision of the Design Act of Japan and the Design Examination Guidelines of Japan before the enforcement of the current Design Act of Japan, and examines the unique development process of the Japanese system of image design in detail by reviewing the background of the revision of the current Design Act of Japan through several problems on status of protection of image design before the revision, which was raised in the process of such revision. In addition, this paper reviews the current Design Act of Japan and the current Design Examination Guidelines of Japan, and examines the purpose and background of the revision of the image design system under the current Design Act of Japan, focusing on the main discussions of the Subcommittee on Design System of Japan, and reviews the details and the related issues on the object of the protection, the registration requirements such as novelty, etc. and determining similarity of designs under the current revised Design Act of Japan. Finally, after reviewing various problems raised through the evaluation of the current system of image design in Japan, this paper mentions the necessity of reviewing the parts suitable for the Korean system of design protection and proposes desirable operation methods for the system of image design on this.
