일반국제법상 강행규범과 대세적 의무 간의 관계

이 글에서는 일반국제법상의 강행규범과 대세적 의무의 관계를 다룬다. 이 양자가 개념상으로는 상이하나 이들이 모두 국제공동체 전체의 근본적 이익의 보호를 목적으로 한다는 점에서는 동일함을 강조한다.(II) 그리고, 이 같은 공통된 목적을 가지는 이 두 개의 규범군은 양자가 실질적으로 일치할 수밖에 없음을 강조한다. 우선, 어떠한 의무의 대세적 성질은 그 의무의 강행적 성질 자체로부터 도출되는 만큼, 어떠한 대세적 의무가 강행규범으로 인정되기 위하여 별도의 승인 또는 인정이 필요 없다고 할 수 있다. 일반국제법상의 대세적 의무는 국제공동체 전체의 근본적 이익의 보호를 목적으로 하는 만큼, 이는 당연히 강행규범의 범위와 일치하는 것이라 할 수 있다. 마찬가지 맥락에서, 대세적 의무는 그 범위에 있어서 강행규범과 일치하며, 전자는 오로지 후자로부터 도출된다고 할 수 있다. 또한, 이 양자는 그 내용에 있어서도 일치할 수밖에 없는 것이다. 요컨대, 강행규범에 의하여 모든 국가들에게 부과되는 의무가 대세적 성질을 갖는 만큼, 강행규범과 대세적 의무는 국제공동체의 근본이익 보호를 목적으로 하는 규범이라는 동일한 실체를 구속력의 강도와 책임추궁의 자격이라는 다른 각도에서 바라본 것이라고 할 수 있다.(III)
Abstract
This paper deals with the relations between peremptory norms and obligations erga omnes in general international law. First of all, it points out that these two categories of norms show difference in concept while they are basically the same in that both of them aim at the protection of the fundamental interests of the international community as a whole.(II) Sharing the same purpose, they cannot help being substantially identical. It is not required for obligations erga omnes to be specially accepted and recognized by the international community as it is needed in the case of peremptory norms, in as much as the erga omnes nature of an obligation is derived from its peremptory character. In the same context, the extent of obligations erga omnes in general international law is in accord with that of peremptory norms, and the former can be drawn exclusively from the latter. There is virtually no difference between the two types of norms in the aspect of contents. These norms and obligations could be regarded as the same substance viewed from two different perspectives: strength of binding force and locus standi.(III)
