세종의 공법(貢法) 제정과정을 통한 부동산 조세정책 연구

초록
[연구목적]이 연구는 세종의 공법(貢法) 도입부터 제정까지의 논의과정을 분석하여 오늘날 부동산 조세정책 결정과정에 대한 시사점 제시를 목적으로 한다. 이를 위해 조선왕조실록을 기반으로 도입논의, 수정 및 재논의, 최종 제정 내용을 확인하고, 단계별 논의내용 및 수정요인을 분석한다. [연구방법]조선왕조실록 중심으로 문헌분석을 진행하며 사회문제 인식, 정책형성, 정책결정, 정책집행, 정책평가에 따른 정책과정(policy process) 모형을 활용한다. [연구결과]1430년 공법(貢法) 초안은 일괄 정액세제를 구상하였지만 반대의견에 따라 재(再)논의과정을 거치게 되며 차등 정액세제로 전환된다. 이 역시 제도적 한계가 있어 수정단계를 거치게 되며, 1444년에 초안과는 다른 정률세제 방식의 공법(貢法)이 제정된다. 이러한 단계별 변화의 중심에 세종의 조세공평 실현과 정책결정과정에서 다각적 논의가 있었고, 그 결과 약 190여 년 동안 지속할 수 있는 제도로 정착할 수 있었던 것으로 평가된다. [연구의 시사점]세종은 공법(貢法) 도입과정에서 특정집단의 수혜 및 손실에 대해 경계하였고, 이를 위해 약 15년이라는 논의과정을 갖게 된다. 오늘날 정책적 결정 및 실현 과정과는 차이가 있다. 향후 장기적 측면에서 일관성 있는 정책과 충분한 사회적 합의가 반영된 정책수립이 필요하다.
Abstract
[Purpose]The purpose of this study is to present implications for today’s realestate tax policy by analyzing the discussion process up to the enactment of Gongbeop(land tex). [Methodology]The literature analysis is conducted focusing on the Annals of the Joseon Dynasty, and a policy process model based on social problem recognition, policy formation, policy decision making, policy execution, and policy evaluation is used. [Findings]In 1430, the draft proposed a lump－sum flat tax system through fixed tax revenues, but it was converted to a differential flat tax system. This also has institutional limitations, and it is enacted in a flat tax method different from the 1444 draft. There were various discussions in the process of realizing tax equity and making policies. [Implications]Sejong was wary of the benefits and losses of specific groups in the introduction process, and it has a discussion process of about 15 years. Today, there are some differences from policy decisions and realization. In the future, it is necessary to establish policies that reflect consistent policies and sufficient social consensus in the long term.
