중국 노인권익보장법제에 관한 연구

Korea and People’s Republic of China(PRC) have made laws related to welfare for Senior Citizens in preparation for the ever-increasing elderly population. Law of the PRC on Protection of the Rights and Interests of the Elderly(hereinafter referred to as Elderly Act) is corresponding to Welfare of Senior Citizens Act of Korea. In this study, First, explains that China has entered an aging society since 2000, that the Elderly Act enacted in 1996 has been amended four times. And also considered the constitutional basis and legislative purpose of the Elderly Act, and classification of senior citizens’ rights. The rights of senior citizens can be classified into the right to support and maintenance, and the right to receive social security based on the supporting subject of the rights of senior citizens. Second, explains the subject that guarantees the right to support and maintenance, the obligations of the subject, and the means of guaranteeing the right to support and maintenance. Third, explains the right to receive social security, and the right to receive social security can be classified into the right to receive material assistance from the state and society, the right to receive social services, the right to receive social preferences, and the right to participate in social development. Finally, in place of conclusion, through comparative studies on elderly act between Korea and China try to find advantages that could learn from each other.
