진영논리 속 ‘혐오 표현’에 대한 대응 방안 고찰: ‘양지(良知)’와 ‘양심(良心)’에 기반한 자존감을 중심으로

본 연구는 진영논리에서 발생하는 ‘혐오 표현’의 폐해를 살펴보고, 가해자와 피해자의 관점에서 그것을 극복할 수 있는 대응 방안으로서 ‘양지’와 ‘양심’에 기반한 자존감을 중심으로 연구하는 것을 목적으로 한다. 현재 우리나라를 비롯한 세계 각국에서 혐오 표현을 개선하기 위해서 처한 여건을 고려하여 그것을 규범화 또는 법제화하려는 시도를 신중하게 적용하며 보완해가는 중이다. 하지만 ‘혐오 범죄’와 ‘혐오 표현’을 동일시했을 때 그에 따른 표현의 자유를 침해할 수 있는 가능성에 대한 부분 또한 간과할 수 없다. 따라서 이에 대한 현실적 적용 부분에서 보이는 양가적 상황으로 인해, 가해자는 법의 간극을 이용해 ‘표현의 자유’와 ‘혐오 표현’의 사이에서 교묘히 빠져나가는 상황을 보인다. 우리는 사회에서 당위와 규율적인 부분만을 통해 인간의 삶의 방식을 근본으로 변화시키기에는 한계가 있기에, 그 변화를 타율적 요인과는 다른 관점에서 스스로 자존감을 체득하고 자각할 때 변화할 수 있는 가능성에 주목할 필요가 있다. 그 자존감은 일반적인 자신감이나 자부심과는 다르며, 공심을 기준으로 한 왕수인의 ‘양지’와 프랭클의 ‘양심’과 연결하여 볼 수 있다. 이렇게 체득하여 자각한 자존감은 타자의 혐오 표현에 대응하여 주체적 존재로서 극복할 수 있는 요인이 될 뿐 아니라, 궁극적으로는 타자에 대한 존중감을 가지고 혐오 표현을 미연에 예방할 수 있는 사회 문화와 관습을 이루는 데 이바지할 것이다.
Abstract
The purpose of this study is to examine the harmful effects of ‘hate speech’ that occurs in camp logic, and also to research self-esteem based on ‘innate knowledge’ and ‘conscience’ as the measures for coping with it in the viewpoint of assailant and victim. Currently, many countries including Korea are carefully attempting to standardize or legalize the improvement of hate speech by considering each condition or environment. However, when regarding hate crime in the same light as hate speech, the frequent violation of freedom of expression cannot be excluded. Thus, in the realistic application of it, the assailants skillfully escape the situation between freedom of expression and ‘hate speech’ by using the interstices of laws. We are limited to fundamentally change our lifestyle through the rightfulness and regulations in society, so we should find the change by learning and realizing self-esteem for ourselves instead of heteronomous factors. The base of self-esteem could be found from Wang Shouren’s ‘innate knowledge’ and Frankl’s ‘conscience’ through existential experience, and the self-esteem obtained like this could contribute to the achievement of social culture and custom to prevent hate speech in advance through the expansion of responsibility beyond overcoming hate speech.
