금융상품의 그린워싱 규제에 관한 연구

With the advent of ESG, the capital market face a historic change. The ideologies that used to lead the capital market are forming a more mature market through dialectical development. Along with these changes of the times, ESG is causing new social issues. That's what “Greenflation”, “Greenwashing”, and “Reverse Discrimination in the Composition of Executives” is it. However, since ESG-related issues have various stakeholders such as general citizens, corporate managers, corporate members, and investors, it is difficult to present an answer that can actually solve the problem by presenting one uniform principle. Therefore, ESG-related problems require efforts to find the best solution for each individual case. Therefore, this study aims to study the regulation of greenwashing of financial products. In particular, it aims to identify fundamental rights issues related to the regulation of greenwashing of financial products, and propose policy measures to regulate greenwashing of financial products under legal order. So, In this study, we will examine the regulatory systems for greenwash financial products in Korea and overseas from a comparative perspective. Based on this, we will derive measures to improve the domestic greenwash regulation system, and based on this, we will examine the legitimacy of the issue of fundamental rights limitation, which may conflict with greenwash regulations, based on the theory of fundamental rights limitation.
