공정한 재판을 위한 메타버스 형사법정의 구현 가능성, 그 의의 및 한계

초록
정보통신기술의 발달은 재판제도에도 영향을 미친다. 컴퓨터 등 휴대용 통신매체의 보급과 인터넷 전산망 확대는 원격영상재판을 가능케 했고, 최근의 코비드-19 팬데믹 상황과 맞물려 민사재판뿐만 아니라 형사재판에서의 원력영상재판 범위가 대폭 확대되었다. 근래 국내외적으로 급성장하고 있는 메타버스 산업 역시 그 기술적 특징 등을 고려할 때 형사재판제도에 영향을 미칠 가능성이 전혀 없지 않다는 예측하에, 본 논문은 메타버스 플랫폼에서 형사법정이 열릴 경우, 그 공정성 제고 가능성에 주목하여 분석하였다. 메타버스 플랫폼에서 형사법정을 개최하게 된다면, 기존의 온라인재판의 장점(사법접근성, 실체적 진실의 발견가능성, 법원업무효율성 제고)과 더불어 편견으로 인한 재판의 불공정 위험성 약화, 전관예우 관행 약화, 재판에의 집중도 향상, 공개재판원칙의 원활한 구현, 위법수집증거의 부당한 영향력 차단 등의 긍정적 효과를 거둘 수 있으리라 보인다. 다만, 그 실효성은 아바타 기술의 발전에 의존하는 측면이 있고, 메타버스 법정에서 아바타 기술을 적극 활용하더라도 이는 편견의 작동 가능성을 오프라인 재판에 비해 줄일 수 있다는 것이지 온전히 제거할 수 있다는 의미는 아니므로 그 영향력은 제한적이다. 교육이나 기타 사법자원의 효율적 배분 등 공정한 형사재판의 실현을 위한 다각도의 지속적 노력이 필요하리라 본다. 다른 한편 아바타를 활용한 형사재판은 직접심리주의의 실현을 어렵게 하고 이는 실체적 진실의 발견이나 적법절차원칙에 부정적 영향을 줄 수 있다는 한계가 있다. 그럼에도 불구하고, 형사재판에서 직접심리주의의 예외가 인정되고 있고, 특히 사법부담을 경감하기 위해 플리바게닝제도를 적극 활용하는 미국의 경우 형사재판에서 인종갈등문제를 줄이고자 메타버스형사재판제도를 도입할 가능성이 전혀 없지 않으며, 미국 재판제도가 국내외 재판제도에 영향을 끼치는 것을 고려하면, 경미사건이나 피고인이 동의한 사건 등 일부 사건의 경우 메타버스 형사재판의 도입가능성이 전혀 없지 않음으로 이에 대한 지속적 관심이 필요해 보인다.
Abstract
The development of information and communication technology has been influencing, to a greater or lesser, the justice system. The proliferation of PC and cell phones with the expansion of the internet made remote video trials possible, and during the COVID-19 pandemic the remote video trials has been rapidly expanded in criminal as well as in civil trials in Korea. Recently, the emergence of the metaverse and the development of its related technologies let us look at other option of the virtual trial, the criminal trial in the metaverse. The litigation scenario in a virtual reality courtroom with an accused avatar and a judge avatar, etc., is likely a long way away. However, it is worth speculating the benefits and the limitations of the metaverse criminal trial, considering it could be a chance to reduce racial discrimination thanks to the avatar accused’s race-neutral appearance. This article explores and analyzes the advantages and disadvantages of the metaverse criminal court, focusing on the improvement potential of the judicial fairness. The criminal trial on the metaverse platform is expected to get the advantages of existing remote video trials (enhancing access to the judicial process, possibility of discovering substantial truth and the court performance efficiency) and has a special strength to lessen the risk of the unfair trial due to prejudice. However, its positive influence depends on the development of avatar technology, and even when it works well, metaverse trial doesn’t make the prejudice disappear but decrease compared to the offline trial. For achieving criminal justice free from all unjust preconceptions, are needed other efforts such as education and efficient distribution of judicial resources.
