신경윤리학의 법정책적 거버넌스 정립을 위한 「뇌연구촉진법」개정에 관한 소고(小考)
A Study on the Revision of the 「Brain Research Promotion Act」 for the Establishment of Legal Policy Governance in Neuroethics

현재 뇌연구는 인공지능, 기계와 연결하는 등 융합기술로 진화하며 인간의 존엄성과 정체성에 대한 의문 등 다양한 문제를 발생시키고 있다. 그러나 뇌연구로 인한 법률적, 윤리적, 사회적 문제에 대한 논의와 대안 준비가 미비한 현실이다. 뇌연구로 인한 윤리적 문제를 연구하는 분야를 신경윤리학이라고 한다. 해외 주요 선진국은 뇌연구 촉진과 더불어 신경윤리학에 대한 활발한 연구를 수행 중이다. 우리나라는 1998년부터 국가 차원에서 뇌연구 진흥을 위해 「뇌연구촉진법」을 제정하여 시행하고 있다. 그렇지만 뇌연구의 성과 활용과 기술의 산업화에만 주력하고 있는 현실이다. 이제 우리나라도 신경윤리학을 기반으로 다양한 사회적 공감대를 형성해 미래 문제에 선제적으로 대응하도록 노력해야한다. 뇌연구로 인한 문제에 대해 효과적으로 대처하기 위해서는 새로운 법정책적 거버넌스가 필요하다. 정부, 전문가, 일반인들이 함께 신경윤리학에 대하여 논의하고 참여하는 사회적 기반을 제도화할 필요가 있다. 이를 위해서는 「뇌연구촉진법」을 개정할 필요가 있다. 개정의 주요내용으로는 ① 뇌연구의 미래 방향성 설정과 사회적 공감대 형성을 위한 ‘국가신경윤리위원회’를 설치하여 운영하며, ② 이런 제도적 노력을 정책적으로 뒷받침하고, 실무적으로 국제협력 연구를 활성화하기 위해 ‘국제신경윤리센터’를 지정하여 운영할 필요가 있다. 이러한 법정책적 거버넌스 구축은 우리 사회가 뇌연구로 인한 새로운 사회변화에 대하여 능동적으로 대처할 수 있도록 기반을 제공할 수 있을 것이다.
Abstract
Currently, Neuroscience is evolving into convergence technologies such as artificial intelligence and connection with machines, causing various problems such as questions about human dignity and identity. However, discussions on legal, ethical, and social problems caused by neuroscience and preparation for alternatives are insufficient. The field of studying ethical problems caused by neuroscience is called neuroethics. Major developed countries abroad are conducting active research on neuroethics along with promoting neuroscience. Since 1998, Korea has enacted and implemented the Brain Research Promotion Act to promote neuroscience at the national level. However, it is a reality that only focuses on the use of the results of neuroscience and the industrialization of technology. Now, Korea should also try to preemptively respond to future problems by forming various social consensus based on neuroethics. New legal policy governance is needed to effectively cope with problems caused by neuroscience. It is necessary to institutionalize the social foundation on which the government, experts, and the general public discuss and participate in neuroethics together. To this end, it is necessary to revise the Brain Research Promotion Act. As the main contents of the revision, it is necessary to establish and operate the "National Neuroethics Committee" to set the future direction of brain research and form social consensus, and to designate and operate the "Global Neuroethics Center" to support these institutional efforts in policy and promote international cooperation research. The establishment of such legal and policy governance will provide a foundation for our society to actively cope with new social changes caused by neuroscience.
