EU 회원국의 UNILEX 판례분석과 CISG 적용상의 계약책임

본 연구는 국제물품매매계약에 관한 UN 협약(CISG)의 공식 기관지인 UNILEX의 제반 판결례를 분석 도구로 CISG 체약국임과 동시에 EU 회원국의 판결례에 주안점을 두고 여기에 인용ㆍ집적된 CISG 조문 순차에 따라 그 법적 기준의 추론에 주안점을 두었다. 이상의 결과로서 당해 법적 기준에 대한 명료한 이해를 통해 현재까지 발생한 제반 분쟁에 대한 판단기준을 제공하여 장래 분쟁 발생 가능성 예방은 물론이고 EU 각국과의 국제상사계약에 있어 계약당사자 저마다의 경제적 이해를 보전할 수 있는 단초 제공에 목적을 두었다. EU 회원국을 대상으로 한 UNILEX 판결례는 총 644건으로서 조문 인용 순차에 따라 적용상의 기본원칙(제1조, 284회), 계약부적합의 통지(제39조, 200회), 매수인의 계약해제권(제49조, 114회), 연체금액의 이자(제78조, 101회) 등이 전체 인용빈도(2,186)의 약 30%를 차지하고 있다. CISG 편별 순차에 따라 그리고 우선순위에 따라 본 연구범위로서 선별한 CISG 조문은 적용상의 기본원칙(제01조), 서비스 계약 등의 제외(제03조), 협약의 해석원칙(제07조), 당사자 진술 및 행위의 해석(제08조), 청약의 기준(제14조), 승낙의 시기 및 방법(제18조), 청약을 변경하는 승낙(제19조), 물품검사시기(제38조), 계약부적합의 통지(제39조), 매수인의 계약해제권(제49조), 연체금액의 이자(제78조) 등의 순이다.
Abstract
This study used the judgment of UNILEX, the official journal of the CISG, as an analysis tool. At the same time as being a contracting state of the CISG, the focus was placed on the UNILEX cases centered on EU member states. The focus was on the inference of legal standards according to the sequence of CISG articles cited in unilex. There are 644 UNILEX judgments against EU member states. The CISG articles selected as the scope of this study according to the order of citation of the articles are 'basic principles for application'(Article 1), 'principle of interpretation of convention'(Article 7), 'interpretation of statements and acts of the contractual parties'(Article 8), 'standards for offer'(Article 14), 'time and method of acceptance'(Article 18), 'acceptance to change offer' (Article19), 'time for inspection of goods'(Article 38), 'notice of non-conformity'(Article 39), 'buyer's right to termination of the contract'(Article 49), 'interest on overdue amount'(Article 78), etc.
