국제 난민보호법체계하에서의 튀르키예 난민법

초록
국제사회는 포스트 코로나 시대를 맞이하는 과정에서 전쟁, 지역 분쟁, 자연재해, 기후 변화 등으로 인해 경제위기와 함께 심각한 난민 문제를 겪고 있다. 러시아의 우크라이나 침공으로 인한 강제 이주민 문제는 인근 국가에게 큰 부담을 부과하였다. 역사적으로 국제사회는 난민과 망명 신청자의 권리를 보장하기 위해 노력해왔으며, 난민 보호를 위해 난민협약를 채택하고 유엔난민기구를 설립하였다. 그러나 기존의 국제난민보호 체계가 난민과 망명 신청자의 권리를 충분히 보장하고 있지 않기때문에 포괄적이고 실용적이며 효과적인 국제난민법에 대한 국제 합의가 필요하다. 게다가, 개별 국가는 서로 다른 난민법과 난민 정책을 시행하고 있기 때문에, 난민 보호를 위해서는 국가별로 다른 난민법에 대한 연구가 필요하다. 그 중에서도 튀르키예는 난민 수용의 역사가 길고 세계 최대 난민 수용국으로 난민 대응 사례가 많다. 이 논문은 국제난민법체계와 튀르키예의 난민 법률 현황을 살펴봄으로써 국제난민법이 튀르키예에서 어떻게 적용되고 있는지 검토한다.
Abstract
At the beginning of 2022, the international community seemed to overcome the COVID-19 pandemic although there is still a myriad of problems – economic recession, high global inflation, climate crisis, etc. However, due to the Russia-Ukraine war, which started in February 2022, the world is confronted with another refugee crisis. The international community has tried to facilitate international cooperation for refugee protection and ensure the rights of refugees and asylum-seekers for a long time. For example, the 1951 Geneva convention and the establishment of UNHCR are the results of global efforts. Yet, there has been a constant, urgent need for a comprehensive, practical, and effective international legal framework because the existing international system does not sufficiently guarantee the rights of refugees and asylum-seekers. In addition, each country adopts different refugee policies. Among them, Turkiye, the largest refugee-hosting countries, accepting approximately four million refugees, has its own unique legal system for refugees. This article attempts to provide a comprehensive understanding of Turkish legal system pertaining to refugees by examining Turkish refugee law and its history.
