자녀에 대한 모계 성·본 부여의 제약요소와 그 극복방안 : 온라인 여성 커뮤니티의 담론 분석을 중심으로

초록
오늘날 우리 사회의 성평등 수준은 과거에 비해 상당 부분 개선되었다. 이와 동시에 가족법 역시 상당한 변화를 겪었고, 그 과정에서 지난 2008년부터는 민법 제781조 제1항에 따라 혼인신고시 부부의 협의가 있을 경우 자녀에게 어머니의 성･본을 부여할 수 있게 되는 등 획기적인 제도 변화가 이루어졌다. 그럼에도 불구하고 통계에 따르면, 전체 혼인신고 중 자녀에게 어머니의 성･본을 물려주겠다는 취지의 협의서를 제출한 비율은 극히 미미한 실정이다. 왜 많은 부부들은 자녀에게 어머니의 성･본을 부여할 수 있는 법적, 제도적 기반이 마련되었음에도 불구하고, 이를 활용하지 않는 것일까? 이 글은 이와 같은 의문에서 시작되었다. 이 질문에 대한 답을 얻기 위해 임신･출산과 관련하여 국내에서 가장 활발하게 활동이 이루어지고 있는 네이버 커뮤니티인 ‘맘스홀릭베이비’에 업로드된 게시글과 댓글을 분석하였다. 그 결과 어머니의 성･본 부여에 대한 제약요소를 확인할 수 있었고, 이러한 제약요소를 그 성격에 따라 규범적 제약요소, 가족문화적 제약요소, 사회문화적 제약요소로 구분할 수 있었다. 많은 여성들은 위와 같은 제약요소로 인하여 자녀에게 어머니인 자신의 성･본을 부여하고 싶다는 욕망을 내려놓은 채 관행대로 아버지의 성･본을 부여하고 있었다. 위와 같은 여러 제약요소 중 특히 규범적 제약요소를 제거하기 위하여, 자녀의 성･본 결정 시기를 늦추는 방안, 부성 우선의 원칙에서 부부 협의의 원칙으로 전환하는 방안, 형제･자매의 성･본을 통일시켜야 한다는 원칙을 허무는 방안 등을 고려해 볼 수 있다. 모계 성･본 사용에 대한 규범적 제약요소 제거를 통해 어머니의 성･본을 따르는 자녀들이 많아진다면, 가족문화적 또는 사회문화적 제약요소들은 자연스럽게 사라질 수 있을 것이다.
Abstract
This article suggests that despite the legal change allowing parents to give their children the mother's surname, there are still significant constraints that prevent many couples from doing so. These constraints are classified into normative, family-cultural, and socio-cultural categories. Normative constraints refer to legal principles that prioritize the patrilineal surname. This article suggests that delaying the timing of the surname decision, changing the principle of paternal priority to a couple's agreement, and discarding the principle of unifying siblings' surnames could remove normative constraints. Family-cultural constraints are related to family traditions and expectations, such as maintaining the family line or honoring ancestors. Socio-cultural constraints are related to broader cultural norms and expectations, such as the belief that a child should have the same surname as their father. This article suggests that removing normative constraints could lead to the removal of other constraints, as couples may feel more empowered to make a decision based on their own preferences and values. Overall, this article highlights the complex social and cultural factors that influence the decision of whether to give a child the mother's surname, and suggests potential solutions for removing some of these constraints.
