초록
필자는, 이 연구를 통해, 「민사소송법」, 「비송사건절차법」 「민사집행법」 「채무자 회생 및 파산에 관한 법률」 등 현행 법률의 규정과 해석에 의하면 법무사에게 민사집행 사건 등 비송사건 절차대리가 허용되고 있으므로 법무사가 보수를 받고 그러한 대리행위를 하는 것은 적법하고, 그러한 법무사의 대리행위는 변호사법 위반죄로 처벌될 수 없음을 규명했다. 그러므로 민사집행 사건 등 비송사건의 절차대리를 인정하지 않고, 민사집행 사건이나 개인회생, 파산 등 비송사건에 관한 포괄적 서류 작성ㆍ제출 대행의 수임을 사실상 그러한 대리의 수임으로 보고 이것조차 인정하지 않으며, 법무사가 위임인을 위해 서류를 작성해서 제출할 때마다, 제출하는 서류마다 위임장의 제출을 요구하는 법원의 실무는 무엇보다 먼저 시급히 시정되어야 한다. 그리고 민사소송법 제87조의 규정에 의한 변호사 대리의 원칙이 민사집행 사건 등 비송사건 절차, 특히 법관이 아닌 사법보좌관에 의해 처리되는 절차에도 그대로 통용될 수 있는 것인지를 재고하고 관련 법령과 대법원예규의 개정ㆍ정비에 힘써야 한다.
Abstract
Through this study, I found that judicial scriveners are permitted to represent in non-contentious cases or proceedings according to the current laws(Civil Procedure Act, Non-contentious Case Procedure Act, Civil Execution Act, Debtor Rehabilitation And Bankruptcy Act etc.) and interpretations, so it is lawful for judicial scriveners to perform such representation in exchange for compensation, and such representation by a judicial scrivener cannot be punished for violating the Attorney-at-Law Act. Therefore, the court practices, while do not permit certified judicial scriveners to represent in non-contentious cases, and even do not permit to be consigned comperehensive document preparation and submission for civil enforcement or individual rehabilitation cases and other non-contentious cases, and whenever a document is prepared and submitted for the client, each document submitted requires the requesting document, must be corrected first and foremost. In addition, it is necessary to reconsider whether the principle of representation by attorney-at-laws under the provision of Article 87 of the Civil Procedure Act can be used in civil enforcement cases and other non-contentious cases, especially those handled by judicial assistant officials, and to revise and supplement relevant laws and Supreme Court regulations.
