The Standard Hours for Converting Ordinary Wages into Hourly Wage

This article aims to organize and analyze the interpretation of the standard hours for converting ordinary wages into hourly wage. We will analyze the changes in the laws and precedents regarding the method of calculating the standard hours, present the theory of interpretation in the current law, and present appropriate legislative directions. Interpretation of it has changed according to changes in legislation and precedent. In particular, there are many issues in the interpretation of the number of contracted overtime hours, but an appropriate understanding was sought as much as possible. In particular, there are many issues in the interpretation of hours considered for weekly holiday pay, hours of allowance to compensate for reduction in working hours, and hours reflecting contracted overtime works, but an appropriate understanding was sought as much as possible. According to the existing interpretation, the corresponding hours of the weekly holiday pay (so hours considered for weekly holiday pay), the corresponding hours of allowance to compensate for reduction in working hours, and the hours reflected in the contracted overtime works are added to the standard hours as paid hours. Such an interpretation method has many irrational points and is not valid against the mandatory regulation. Ultimately, a legislative solution is needed to overcome the current interpretational problems. In addition, legislation must be clearly regulated and easy to understand. In this regard, legislation that stipulates the standard hours only as the number of prescribed working hours is desirable. The specific legislative direction may vary depending on how to add respect for labor-management autonomy. The study on this is left as a future research task.
