농지법상 농지(農地)의 판단 기준 - 지목(地目)의 기능을 중심으로 -

농지법에서는 지목이 전·답, 과수원인 토지는 본연의 농지로 상정하여 그 밖의 토지와는 차등적으로 규율하고 있다. 이러한 규율 체계는 농지법이 현황주의를 채택하고 있음에도, 지목이 농지인지 여부를 판단하는 기준으로 기능함을 의미한다. 지목이 가지는 실질적인 기능이 중요시되면서 현행 실무에서는 종래의 현황주의와 지목 사이에 어느 기준을 우선시하여 농지인지 여부를 판단하여야 하는지 다투어지고 있다. 농지인지 여부가 다투어진 그간의 판례의 흐름을 살펴보면, 법원은 현황주의에 기초하여 농지를 판단하면서도, 원상회복의 용이성(농지로서의 현상을 상실하고 그 상실한 상태가 일시적이라고 볼 수 없는 경우)이라는 법리에 기초하여 현황주의의 적용을 제한하여 왔으며, 최근에는 규범적인 판단 기준(농지로서의 이용에 불법적인 행위가 관여되었는지)을 고려하여 그 적용 범위를 더욱 축소하고 있다. 판례가 제시한 규범적 판단 기준은 종래의 현황주의라는 사실적 판단 기준과는 양립하기 어려운 것으로, 판례가 농지의 판단에 관한 새로운 기준을 제시한 것으로 해석할 수 있다. 규범적 판단 기준은 농지의 판단 기준이 현황주의에서 지목주의로 변화하고 있음을 의미하고, 지목을 기준으로 토지의 이용가능성을 판단하는 실무의 흐름에 맞춰 농지의 판단에 관한 법리가 발전한 것으로 평가된다. 지목은 건축허용성을 판단하는 기준이라는 도시계획적 기능 외에도 농지법상 농지를 판단하는 기준으로 기능하기 시작하였다. 지목이 수행하는 공법적 기능이 점차 다양해지고 그 효력이 강해짐에 따라, 토지를 규율하는 국토계획법, 지적을 규율하는 공간정보관리법, 농지를 규율하는 농지법 등의 상호 체계에 있어서도 지목의 기능을 고려한 보다 체계적이고 정합적인 해석이 필요하다. 이를 위해서는 산지관리법의 규율 체계와 같이 종래의 현황주의가 아닌 지목을 기준으로 농지를 판단하여야 하고, 농지법상 농지의 정의 규정에 대한 개정도 필요하다고 생각한다.
Abstract
In the definition of farmland under the Farmland Act, land category as fields, paddy fields and orchards are assumed to be original farmland and are regulated differently from lands of other categories. This regulatory system means that even though the Farmland Act adopts the status quo principle, land category functions as a criterion for judging whether a land is farmland. Even in that farmland is defined depending on the land category, it should be seen that the land category functions as a principle criterion for judging farmland. However, in the current practice, when it is an issue whether it is farmland or not, there is a problem in that the land category principle is overlooked while only the status quo principle is emphasized. Based on the precedents in the past when whether it is farmland or not, the court has judged farmland based on the status quo principle, but the legal criteria of ease of restoration (when the status quo as farmland is lost and the loss cannot be regarded as temporary) based on this, the application of the status quo principle has been limited, and recently, the scope of its application is further limited in consideration of the normative judgment criteria (whether illegal activities were involved in the use of farmland). The normative judgment criteria presented by the precedent is incompatible with the factual judgment criteria of the existing status quo, and it should be understood that the precedent presented a separate standard for farmland judgment. In that it is incompatible with the status quo principle, the normative judgment criteria means that the criteria for farmland judgment is changing from the status quo principle to the land category principle. It can be evaluated that the law principle has developed. The permission to divert farmland has the function of regulating the illegal diversion of farmland for the purpose of preserving farmland, and for that purpose, it should be seen that the subject of the permit is limited to the original farmland, which is a field, a paddy field, or an orchard. Land category, which is the criterion for judging whether it is original farmland, functions as a criterion for determining whether it is subject to permission for diversion to farmland, and ultimately functions as a criterion for judging whether it is farmland or not through the normative judgment criteria suggested by precedents. In addition to the urban planning function of judging development permission, land category functions as a criterion for judging farmland under the Farmland Act. As the administrative functions performed by land category gradually diversify and become more effective, it is time for a more systematic and thorough interpretation considering the administrative functions of land category in the regulatory system of the Farmland Act, the Act on the Establishment and Management of Spatial Data, and the National Land Planning and Utilization Act.
