국제법 연구 주제의 심화와 확대 - 1960년대 한･일 관계의 국제법 현안 관련 연구부터 2010년대 EU법 관련 연구까지 -

This article examines the history of international law studies at Yonsei University, focusing on the figures who had taught international law at Yonsei University. It is a significant task to organize the footprints of international law studies centering on each person. The history proves that the topic of international law studies has been deepened and expanded. In particular, the paper reviews Dokdo-related and EU law-related research at Yonsei University. In the 1960s, the contemporary issue of international law in Korea-Japan relations was the matter of Dokdo. Responding to Japan’s unfounded claims about Dokdo, Professor Dong-wook Shin and Professor Kwan-sook Park had criticized Japan by invoking the appropriate principles of international law rather than by displaying negative emotions. As long as Japan’s baseless assertion continues, it is natural that research on international law relating to Dokdo should continue. The reason for this is that the United Nations Convention on the Law of the Sea introduces a ‘compulsory’ dispute settlement procedure through Section 2 of Part XV, and recent cases by international courts and tribunals confirm that there is a possibility of extending their jurisdiction to ‘incidental questions’. This means that unlike the 1960s, research on international law relating to Dokdo cannot only be limited to territorial issues. In addition, international law studies at Yonsei University have been conducting research on European Community law/EU law, which was once unfamiliar to the Korean international law academia, as well as research on GAL. This shows the ‘expansion’ of topic of international law studies at Yonsei University, and it is suggested that the expansion of topic of international law studies would be the right direction for Yonsei University’s international law studies.
