디지털성범죄 예방을 위한 제도적 검토

In our society, due to the transition of a non-face-to-face society due to the COVID-19 era, a new type of risk factor that can infringe on legal interests in virtual reality is increasing by utilizing information and communication technology developed in recent years. Through a series of incidents such as the Burning Sun incident, the distribution of child pornography on the dark web, and the Nth Room incident, the whole nation was in great shock and confusion, and it was necessary to recognize the seriousness of rapidly evolving digital sex crimes and come up with countermeasures. Accordingly, various legal and institutional mechanisms were prepared, including the addition of criminal constituent requirements and the increase of the statutory sentence, reflecting the legal sentiment of the people who demand strong punishment and monitoring, but problems still remain to be improved. Prevention of digital sex crimes is important, but follow-up measures are more important than anything else to prevent secondary damage such as monitoring, deletion support, counseling of victims, and medical and legal support. Accordingly, this study emphasized the need to establish an international cooperation system and join the European Convention on the Prevention of Cybercrime as a way to increase the efficiency of deletion support, delete illegal video distribution media, introduce and expand harmful site search systems using artificial intelligence (AI) or chatbot technology. We hope that the establishment of a dedicated organization to realize effective policies to prevent and prevent digital sex crimes, recruit professionals, and establish new regulations on punishment for crimes by virtual characters on virtual reality platforms will reduce digital sex crimes and prevent them from being protected and supported by the state or society.
