WTO 분쟁해결체제의 중재 절차 활용에 관한 연구 - 튀르키예*-의약품 사건(DS583) 상소 중재 사례 고찰 -

2022년 7월 25일 세계무역기구(WTO) 역사상 최초로 분쟁해결양해(DSU) 제25조에 기반한 상소심인 ‘튀르키예-의약품 사건’ 패널 판정에 대한 상소 중재 판정이 나왔다. 이 판정은 WTO의 상소기구 기능이 정지된 상황에서 중재 절차가 상소심의 대안으로 고려될 수 있는 가능성을 제시했다는 의미가 있다. 일반적으로 중재(arbitration)란 분쟁을 소송(litigation)과 다른 절차를 통해 해결하는 수단이라는 점에서 이른바 ‘대체적 분쟁해결수단’으로 분류되는데, WTO 분쟁해결체제에서도 중재를 도입하고 있다. 그러나 지금까지 회원국들의 중재 활용도는 매우 낮았다. 최근 들어 WTO의 지나친 사법화를 경계하는 목소리와 함께 상소기구의 기능 정지에서 비롯된 WTO 분쟁해결체제 전반의 개혁 움직임이 이어지면서 대체적 분쟁해결 수단으로서의 중재 활용에 대한 관심이 높아지고 있다. WTO 분쟁해결양해(DSU) 상의 중재는 크게 일반적인 분쟁해결수단으로서의 중재(‘DSU 제25조’)와 패널 판정의 이행 등 구체적 사안과 관련하여 WTO의 전형적인 분쟁해결절차를 보완하는 중재(‘DSU 제21조 3항’ 및 ‘제22조 6항’)의 두 가지 형태로 나뉜다. 본고에서는 상호합의를 통해 패널 및 상소기구를 대체할 수 있고 구속력 있는 판정이 가능한 ‘DSU 제25조 상의 중재’를 중심으로 기술한다. DSU 제25상의 중재는 그 자체로 중재로서의 성격을 지니지만, WTO 분쟁해결절차의 틀 내에서 진행되는 내재적 한계가 존재하는 독특한 방식의 중재라고 볼 수 있다. 즉 중재의 기본 특징인 ‘사적자치’를 기반으로 하면서도 WTO 분쟁해결체제가 가지고 있는 ‘사법성’ 역시 동시에 가지고 있어 일반적인 국제중재와는 구별된다. 아직 WTO 체제에서 DSU 제25조를 통한 중재 사례가 많지 않아 분석의 한계가 있으나, 동 중재의 활용 범위가 ‘모든 무역분쟁’에 해당하고 ‘절차적 유연성’이 크다는 점은 큰 장점으로 작용할 것이다. 또한 여타 국제중재와 달리 준거법에 대한 다툼이 없고 회원국들이 합의하면 사무국의 지원도 가능하다는 점도 장점이 될 수 있다. 다만, 중재인 선정 및 이의제기, 이행 절차 등에 있어 당사자들의 사적자치가 일부 제한되고, 중재지 개념이 없어 각국의 국내법 체계나 공공정책 등의 개입 여지가 차단되는 것은 여타 중재와의 차이점으로 지적될 수 있다. 그렇다 하더라도 주요 국제중재규칙에서 활용할만한 내용들이 WTO 체제 로 들어와 구체화되고 사례가 축적된다면 DSU 제25조 중재가 패널 및 상소기구를 통한 분쟁해결의 대체적 수단으로 자리매김할 가능성이 크다. 이를 위해서는 DSU의 규정과 여타 중재규칙들과의 관계, 도입방식 등에 대한 심층 연구가 뒤따라야 할 것으로 보인다. 최근 들어 다자간임시상소중재(MPIA)를 비롯하여 패널 판정에 대한 상소심을 중재절차를 통해 진행하는 방안이 거론되고 있어 매우 고무적이다. 또한 DSU 제25조 상의 중재를 상소심에서 활용한 첫 번째 사례인 ‘튀르키예-의약품 사건’은 상소 중재의 활용방안 및 개선점 측면에서 시사하는 바가 크다. WTO 상소기구 기능이 정지된 상태에서 임시적인 방편으로 제기되고 있는 것이기는 하나, 그간 WTO 상소 제도에 대한 불만 등으로 방치되다시피 하고 있는 상소심을 회원국들 간의 합의로 진행할 수 있는 길을 터주는 것으로 매우 의미 있는 시도이다. WTO 회원국 간 분쟁해결에 있어 DSU 제25조 상의 중재의 활용 가치는 매우 다양할 것으로 보이는 만큼, 앞으로 WTO 중재의 활용 사례 축적을 기대해 본다.
Abstract
This Article focuses on the arbitration procedures under Article 25 of the DSU for alternatives to the mainstream dispute settlement mechanism such as the panel proceedings. The arbitration mechanism under Article 25 of the DSU is an ‘expeditious’ alternative mechanism that can facilitate the solution of certain disputes that concern issues that are clearly defined by both parties. Until now, however, Members of the WTO have been more focused on the mainstream dispute settlement procedures than the alternative one. Recently, voices have begun to be wary of excessive judicialization of the WTO, and as the function of the Appellate Body has been suspended, arbitration within the WTO has drawn attention again as an alternative dispute resolution tool. Although there are some limitations in analysis due to lack of cases of arbitration through Article 25 in the WTO system, “procedural flexibility” of the arbitration will be a great advantage for the parties involved in disputes. However, it can be pointed out that some private autonomy of the parties, which is the very characteristic of arbitration, is limited in the WTO legal framework in terms of selection of arbitrators, challenging against arbitrators, and implementation procedures and so on. Even so, if the substance that is used in the staple international arbitration rule are embodied within the WTO system and cases are accumulated, arbitration under Article 25 is likely to become an alternative means of dispute resolution through panel/Appellate Body. To this end, in-depth research on the relationship between the DSU's regulations and other arbitration rules, and how those rules should be introduced in the WTO system must be followed in a careful manner. Recently, it is encouraging that an appeal arbitration based on Article 25, including Multi-Party Interim Appeal Arbitration Arrangement (MPIA), is gaining a new momentum. The “Türkiye-pharmaceuticals case”, the first case in which the arbitration under Article 25 was used in the appeal trial, has great implications in terms of the utilization and improvement of the arbitration within the WTO. Although it has been raised as a temporary measure while the function of the WTO Appellate Body has been suspended, it is a very meaningful attempt to pave the way for reform of the WTO appeal system between Members. As the value of using arbitration under Article 25 is expected to vary widely in resolving disputes between Members, we look forward to witnessing as many arbitration cases as possible to be accumulated in the near future.
