상표 희석화에 관한 미국 판례의 동향과 시사점

1927년 Frank Schechter의 논문에서 시작된 미국에서의 상표 희석화 법리는 1995년 연방법(FTDA)에 관련 조항이 입법된 후 2006년에 한차례 개정(TDRA)되어 오늘에 이르고 있다. FTDA 시절에는 실제적 희석화의 입증이 필요한지 아니면 희석화 가능성의 입증만으로 충분한지가 주로 쟁점이 되었는바, 실제적 희석화설을 취하는 Ringling 판결(제4항소법원)과 희석화 가능성설을 취하는 Nabisco 판결(제2항소법원)의 입장이 대립하자, 연방대법원에서 Victoria’s Secret 판결을 통해서 실제적 희석화설로 이 문제를 정리하였다. 이에 연방의회가 희석화 가능성설을 취하는 법 개정(TDRA)을 통해서 Victoria’s Secret 판결을 폐기하였으나, Starbucks 판결의 예에서 보듯이 미국 법원은 여전히 희석화 조항의 해석과 적용에 있어서 엄격하고 신중한 태도를 견지하고 있다. 미국 법원의 판례들은 부정경쟁방지법과 상표법에 희석화 조항을 두고 있는 우리 법의 해석과 적용에도 많은 시사점을 던져주고 있는데, 희석화 조항은 그 규정의 모호성과 적용범위의 광범위성 및 표현의 자유 침해가능성이라는 문제점을 안고 있고, 그 보호법익에 있어서도 소비자 보호와는 관계없이 지나치게 상표권 보호에 치중한 조항이라는 점을 항상 고민해야 한다. 미국 판례들은 희석화 조항의 남용을 막기 위해서 희석화 적용시 엄격한 유사성 판단과 고려 요소들 사이의 신중한 형량이라는 방법을 사용하는바, 이는 우리 법의 운용에 있어서도 큰 참고가 될 것이다.
Abstract
Since Frank Schechter’s first publication on trademark dilution in 1927, the Federal Trademark Dilution Act (FTDA) was legislated in 1995 to codify dilution cause of action into federal statute and the Trademark Dilution Revision Act (TDRA) was enacted in 2006 in order to amend some provisions of FTDA. This article examines major U.S. case laws on trademark dilution such as Ringling case (4th Circuit), Nabisco case (2nd Circuit), Victoria’s Secret case (U.S. Supreme Court) and Starbucks case (2nd Circuit). The U.S. case laws have meaningful implications for the interpretation and application of the Korean dilution provisions which were codified in both the Unfair Competition Act and the Trademark Act. Paying attention to the problems and goals of dilution doctrine, the U.S. federal courts have been trying to confine the scope of dilution by blurring by means of their strict interpretation of the similarity between the senior mark and the junior mark and their balancing of six relevant factors in TDRA. Those efforts are important lessons from the the U.S. case laws on trademark dilution that the Korean courts should keep in mind in their practice.
