자동차의 운행과정에서 생성된 데이터에 대한 권리의 귀속; ALI-ELI 제원칙상의 공동생성데이터를 중심으로

In this paper, the contents and attribution of rights to data generated during the operation of connected cars were reviewed, focusing on the ALI-ELI Principles approved by the European and American Law Associations in September 2021. As a result of the review, we may consider adopting the approach of the ALI-ELI principle. Therefore, I considered that, for the data generated during the operation of the connected car, the rights belong to the driver who is the subject of information, or the automobile manufacturer which contributes a great deal for the generation of the data. However, it was also examined that if the data rights are waved in an agreement when purchasing a car is considered valid, the data rights including personal data could be attributed to the automobile manufacturer, and in some instances, a third party may have access rights for public interest reasons. In particular, if access rights are recognized by persons other than the subject of information, measures such as anonymization should be taken to prevent the driver's right to personal data from being damaged. My research may be only a rudimentary stage. In developing the above discussion in the future, I think that it is necessary to find a way to revitalize data transactions without neglecting to protect personal information.
