스토킹범죄 피해자 보호방안에 관한 연구

It is a serious situation worldwide as the act that started as stalking has led to a violent crime. So, stalking punishment laws have been enacted, amended, and implemented in each country. In Korea, the stalking punishment law was legislated in 22 years after the stalking-related bill was first introduced to the National Assembly. However, even before the Stalking Punishment Act came into force, there were high voices of criticism about the contents and methods of the legislation. In particular, after the 'stalking murder case at Sindang Station', it was pointed out that there was a limit to protecting stalking victims, and after that, the government proposed an amendment. This current situation can be understood as a transitional situation experienced in the initial stage of implementation. Therefore, the most important thing at this point is to focus the discussion on how to enact and enforce the stalking punishment law. Punishment for stalking is a law that focuses on protecting victims. In this regard, the direction of revision of the Stalking Punishment Act should be discussed centering on measures to effectively protect victims. In this regard, several improvement plans and policy suggestions regarding victim protection were made in the text. Currently, a total of 33 bills, including lawmakers and government bills, have been submitted to the National Assembly Legislation and Judiciary Committee since the 'Stalking and Murder Case of Sindang Station' in the National Assembly bill information system. The main contents of the recently proposed amendment are also composed of measures that can effectively protect victims, such as expanding the scope of stalking crimes, establishing online stalking punishment regulations, introducing stalking perpetrator location tracking, victim notification system, and victim protection order system. It is impossible to predict in what direction the revision of the future stalking punishment will proceed. However, I hope that the legislation of the Stalking Punishment Act will proceed in a direction that meets the purpose of the legislation, not the purpose, so that the victims can be effectively protected.
