초록
중국 간호사관리제도는 최근 법의 정비로 법치화(法治化)의 방향으로 구체화되는 흐름을 보이고 있으며, 중국 간호사의 합법적 권익을 보장하기 위한 체계적인 간호사법 제정의 필요성이 대두되고 있다. 과거, 중국은 간호사 관리 제도를 규제하기 위해 각종 하위법―명령의 형식으로 일련의 규정을 제정하였지만, 급속도로 발전하는 사회의 변화는 이러한 규정만으로 현대 중국 간호사 제도의 수요를 충족시킬 수 없게 되었다. “중화인민공화국간호사조례(이하 간호사조례로 약칭)” “중화인민공화국간호사조례”는 2008년 1월 23일 국무원 제206차 상무회의를 통과하여 2008년 1월 31일에 공포되었으며, 2008년 5월 12일부터 시행되었다. 이후 2020년 3월 27일, “일부 국무원명령의 개정과 폐지에 관한 국무원의 결정”에 따라 개정하였다. 는 중국에서 자랑스러운 간호사의 “법전”이라 할 수 있는바, 조례라고 하는 자체는 법률이 아니라 국무원의 명령일 따름이다. 따라서 그 위계는 법률보다 낮기에 간호사의 권리를 보장할 수 있는가의 문제가 대두된다. 이에 시대의 발전에 따라 새로운 간호업의 형식이 등장하였고 과거보다 탄력적인 간호사제도의 수요로 새로운 입법의 필요성이 대두하게 되었다.
Abstract
It is necessary to enact a systematic nurse law to ensure the legal rights and interests of nurses as the Chinese nurse management system focuses on the rule of law. In the past, China enacted a series of regulations in the form of various sub-corporate orders to regulate the nurse management system. However, with the development, these regulations cannot meet the current demand for the nurse system. The “Nurse Ordinance of the People's Republic of China” can be said to be a “Code” of proud nurses in China, but the ordinance itself is not a law, but an order of the State Council. Therefore, the hierarchy is lower than the law, so it is a question of whether the rights of nurses can be guaranteed. With the development of the times, a new form of nursing has emerged, and a more flexible nurse system is needed than in the past.
