TBT 협정의 ‘표준’(standard) 개념에 대한 고찰

초록
TBT 협정은 그 강제성 유무에 따라 기술규정과 표준으로 대표된다. 그러나 대부분의 TBT 관련 사건은 기술규정을 중심으로 검토되었으며, 상대적으로 표준에 대한 관심은 높지 않았다. 표준은 국제표준이라는 요건을 검토할 때 주로 검토하게 되는데, 상대적으로 표준 요건보다 ‘국제’ 요건에 더 많은 검토가 이루어져, 표준 자체에 대한 검토는 활발하지 못하였다. 이러한 상황에서 담배 plain packaging과 관련된 사건에서 FCTC 지침이 관련 국제표준에 해당하는지에 대한 검토가 필요하였고, 국제표준의 한 요소인 표준의 개념을 처음으로 상세히 분석하게 된다. Australia—Tobacco Plain Packaging 사건 이전에도 표준의 개념을 해석할 기회가 있었으나 EC-Sardines 사건 및 US—Tuna II (Mexico) 사건에서 제대로 된 분석은 이루어지지 않았다. 본고의 목적은 WTO TBT 협정 부속서 1.2에 나오는 표준의 정의가 어떻게 변화해 왔으며, 그 의미는 무엇인지를 고찰하고자 한다. 특히 초기의 표준 개념이 규범적 수준을 강조하고 있는 데 반해서, 현재의 표준 개념은 그 규범성을 제거하여 정의되었다는 것을 주장하고자 한다. 따라서 Australia—Tobacco Plain Packaging 사건 패널의 표준 분석에서 TBT 협정 부속서 1.2의 정의를 사용하면서도, ISO/IEC Guide 2의 표준화 정의를 가져와서 실질적으로 ISO/IEC Guide 2의 표준 정의를 사용하는 것과 동일한 효과를 내는 위험성에 대하여 비판한다. 특히 문서의 개념을 용어의 통상적 의미에서 시작하지 않고 규범적 문서의 개념을 가지고 표준을 분석하는 것과 공통적이고 반복적인 사용 요건에서 규범성을 오히려 강화하는 방식으로 분석하는 패널의 태도에 대하여는 문제를 제기한다. 표준은 기술규정과 비교하여 그 강제성 유무에 따라 구별되는 특징이 있지만, 표준 자체가 가진 규범적 성격을 연혁적으로 어떻게 제거하여 왔는지에 대한 이해 없이는 표준을 의미를 정확히 파악하기 힘들 것이다.
Abstract
Technical regulations and standards are dependent upon whether they are mandatory or not. However, most TBT-related cases were reviewed focusing on technical regulations and standards were received relatively low interests. Standards are mainly reviewed when examining the requirements of international standards. In this situation, the concept of standard, as an element of international standards, was analyzed in detail for the first time. Even before the Australia—Tobacco Plain Packaging case, there was an opportunity to interpret the concept of standard, but no proper analysis was done in the EC-Sardines and US—Tuna II (Mexico). The purpose of this paper is to examine how the definition of standards in Annex 1.2 to the WTO TBT Agreement has changed. In particular, while the early concept of standard emphasized the normative dimension, the current concept of standard was defined by reducing its normative nature. Thus, in the Australian—Tobacco Plain Packaging case, the panel was criticized by using the definition of standardization in ISO/IEC Guide 2 and actually having the same effect as using the definition of standard in ISO/IEC Guide 2. In particular, the concept of document does not start from the ordinary meaning of the term, but analyzes standards with the concept of normative document and also analyzes in a way that rather strengthens the normativeness in the element of common and repeated use. Compared to technical regulations, standard is distinguished by its mandatoriness. However, it will be difficult to accurately grasp the meaning of standard without understanding how the normative characteristic of standard has been reduced chronologically.
