초록
우리나라 저작권법의 데이터베이스권 규정은 유럽연합 데이터베이스 지침의 독자적 권리(sui generis right) 규정을 모델로 하여 도입되었다. 데이터베이스에 관해 그 제작자에게 배타적 권리를 부여하는 방식의 이 규정은 모델이 된 유럽연합의 지침과 마찬가지로 정보 독점에 관한 우려를 낳았다. 이러한 배경에서 우리 대법원은 최근 ‘야놀자 형사사건’에서 유럽연합사법재판소가‘BHB 사건’ 등에서 제시한 해석론을 수용하여, 데이터베이스권 침해요건을 구체화하여 제시하였다(대법원 2022. 5. 12. 선고 2021도1533 판결, ‘대상판결’). 이 글은 대상판결을 계기로 유럽연합 데이터베이스 지침에 대한 해석론을우리 법의 해석에 차용하는 것의 의미와 한계에 대해, 양 법제의 공통점과차이점을 바탕으로 검토하였다. 대상판결은 유럽연합의 지침과 우리 저작권법의 데이터베이스권 규정의 공통된 입법 목적을 전반적으로 충실하게 고려하였으나, 일부 설시에서 발견되는 부주의함이 있어 지적하였다. 나아가 대상판결을 통해 저작권법상 데이터베이스권 규정의 존치 여부에 관해 다시진지하게 논의할 필요성을 환기하였다. 유럽연합 데이터베이스 지침에 대하여 가해져 온 비판과, 부정경쟁방지법상 부정경쟁행위 규범 확충 등의 법제상황 변화는 데이터베이스에 대한 준물권적 보호에 대한 근원적인 의문을되돌아보게 한다. 대상판결을 계기로 차제에 데이터베이스 보호제도의 개선에 관한 종합적인 논의가 재점화되기를 기대한다.
Abstract
The database rights provisions of the Korean Copyright Act were modeled after the sui generis right provisions of the EU Database Directive. These provisions, which grant exclusive rights to the creator of a database, have raised concerns about information monopolization, just as the EU Directive did. Against this backdrop, the Supreme Court of Korea recently adopted in Yanolja Criminal Case, 2021Do1533 sentenced on May 12, 2022 (hereinafter, “Subject Case”) the interpretation of the CJEU on EU Directive stated in BHB Case and others, as well as providing specific requirements for infringement of the database rights. The Subject Case highlights the need for a serious debate on the viability of the database rights provisions of the Copyright Act. Changes in the legal landscape, such as the critical ideas raised on the EU Database Directive and the expansion of the unfair competition norms in the Unfair Competition Act, have led to reconsideration of the fundamental questions of sui generis rights protection for databases. Following the Subject Case, it is hoped that a comprehensive discussion will resume on how to improve the database protection regime in the future.
