State Duty to Protect Fundamental Rights in relation to Environmental Pollution Caused by Greenhouse Gas Emissions

독일 구(舊) 연방기후보호법에서의 국가의 불충분한 기후보호가 독일 기본법 제2조 제2항 1문과 제14조 제1항에 의거한 국가의 기본권보호의무를 위반하였다며 입법부작위 헌법소원심판을 청구했다. 독일 구(舊) 연방기후보호법에서는 2030년까지 온실가스 배출량을 55%까지 감축하여 지구 기온 상승을 1.5°C로 제한하는 것을 목표로 하였고, 2050년까지 기후 중립 달성을 목표로 하고 있었다. 독일 연방헌법재판소는 독일 구 연방기후보호법 제3조 제1항 2문과 제4조 제1항 3문이 헌법에 합치되지 않는다고 선언하였다. 2031년부터 배출량 감축 목표 개선에 관한 법규정은 헌법적 요청을 충족해야 한다. 입법자는 늦어도 2022년 12월 31일까지 2031년 이후에 배출량 감축 목표의 개선 규정을 적절히 개정할 의무가 있다고 판시하였다. 독일 연방헌법재판소는 국가가 기본권 보호조치를 취했는지 여부와 국가가 기본권 보호를 위해 필요한 보호조치가 완전히 부적합하거나 불충분한지 여부를 판단하는 명백성 통제 기준을 사용했다. 명백성 통제 기준은 입법자에게 광범위한 평가재량과 형성재량을 부여하고 있다. 독일 연방헌법재판소 판례에서 명백성 통제 기준은 과소보호금지원칙의 적용에 있어서 일반적으로 사용되고 있다. 환경오염 사건에서 명백성 통제 기준보다는 상충하는 법익을 고려하여 세밀히 조사된 사실관계와 타당성 있는 평가에 기초하여 적절하고 효율적인 최소한 이상의 보호조치를 취하는지를 심사하는 타당성(설득력) 통제 기준을 사용하는 것이 타당하다. 독일 연방기후보호법 사건에서 독일 연방헌법재판소는 ‘기본권 제한과 유사한 사전효’라는 법적 개념을 개발해냈다. ‘기본권 제한과 유사한 사전효’ 개념은 기본권 제한을 정당화하기 위해 현재 기본권 제한은 없지만, 장래에 제한이 될 개연성이 큰 경우로서 고도의 개연성을 요구함으로써 국가의 보호조치를 가능하게 한다. 그런데 ‘기본권 제한과 유사한’ 국가 행위 개념은 국가의 기본권에 대한 제한 행위를 전제로 하는데, 이산화탄소(CO2) 배출로 인한 사인의 가해를 가하는 경우이므로 기본권의 방어권 논리로 적용하기 어려우며, 국가의 기본권보호의무가 적용되어야 한다. 우리나라에서는 동물장묘업의 지역적 등록제한사유를 규정하고 있는 구 동물보호법 조항이 그 제한사유를 불완전ㆍ불충분하게 규정하여 청구인들의 환경권을 침해한다고 주장하며, 헌법소원심판을 청구한 사건이 있었다. 우리나라 헌법재판소는 이 사건에서 명백성 통제 기준을 사용했다. 명백성 통제 기준을 적용하기 보다는 환경오염으로 인한 생명권 또는 신체의 자유 제한의 경우에는 중요한 기본권에 대한 가해 문제이고, 환경오염으로 인해 중대하고 비가역적인 피해 가능성이 존재하며, 환경 영역에서 적절하고 효율성 있는 기본권보호의무 이행을 위해 ‘타당성 통제’ 기준을 적용할 필요가 있다.
Abstract
Insufficient climate protection under the former German Federal Climate Protection Act violated the state’s duty to protect fundamental rights pursuant to Article 2 paragraph 2 sentence 1 and Article 14 paragraph 1 of the German Fundamental Law, and filed a constitutional complaint against the legislative action. The former Federal Climate Protection Act in Germany aims to reduce greenhouse gas emissions by 55% by 2030, limit global temperature rise to 1.5°C, and achieve climate neutrality by 2050. The Federal Constitutional Court of Germany declared that Article 3 paragraph 1 sentence 2 and Article 4 paragraph 1 sentence 3 of the former German Federal Climate Protection Act were unconstitutional. From 2031, the statutory provisions on improving emissions reduction targets must meet the constitutional request. It held that the legislature was obliged to amend the provisions for the improvement of the post-2031 emission reduction target no later than 31 December 2022, as appropriate. The German Federal Constitutional Court used the obviousness control criterion to judge only whether the state had taken measures to protect fundamental rights and whether the protective measures necessary for the protection of fundamental rights were completely inadequate or insufficient. In the judgments of the German Federal Constitutional Court, the criterion of obviousness control is commonly used in the application of the principle of prohibition of minimum protection. In environmental pollution cases, it is reasonable to use the validity (persuasiveness) control criterion, which examines whether the state takes appropriate and effective minimum protection measures based on closely investigated facts and valid evaluations in consideration of conflicting legal interests. In the case of the German Federal Climate Protection Act, the German Federal Constitutional Court developed the legal concept of ‘prior effect similar to the violation of fundamental rights’. The concept of ‘prior effect similar to the violation of fundamental rights’ makes it possible for the state to take protective measures by requiring a high degree of probability in the case where there is no fundamental rights violation at present, but there is a high probability of future violation to justify the violation of fundamental rights. However, the concept of ‘prior effect similar to the violation of fundamental rights’ presupposes an act of intrusion on the fundamental rights of the state, but it is difficult to apply it as the logic of the right to defend rights because it is the case of inflicting harm on a person due to carbon dioxide (CO2) emission. Rather, the state’s duty to protect fundamental rights should be applied. In Korea, there was a case in which a constitutional complaint was filed claiming that the provisions of the former Animal Protection Act, which stipulates the grounds for regional registration restrictions on animal burial grounds, violated the petitioners’ environmental rights by incompletely or insufficiently stipulating the grounds for the restrictions. The Constitutional Court of Korea used the obviousness control criterion in this case. In the case of restriction of the right to life or personal freedom due to environmental pollution, rather than applying the obviousness control standard, it is a matter of harm to important fundamental rights, there is a possibility of serious and irreversible damage due to environmental pollution, and it is necessary to apply the validity control criterion to properly and efficiently fulfill the duty to protect fundamental rights.
