아동방임범죄의 문제점과 개선방안

초록
현행 아동복지법상 학대행위로서 방임행위에 관한 규정이 너무 추상적이다. 무엇이 ‘기본적인 보호･양육･치료 및 교육’인지 그리고 ‘소홀히’라는 의미가 어느 정도인지 그 범위가 너무 모호하다. 이 때문에 아동방임으로 의심되는 사건이 발생하더라도 현장에 출동한 사법경찰관리와 아동관련 종사자들이 아동방임사건인지 분별하는데 어려움을 주고 있다. 결국 방임피해아동을 실효성 있게 보호하지 못할 뿐만 아니라, 아동방임에 대한 효율적인 예방과 대처를 어렵게 한다. 이를 해결하기 위해서는 죄형법정주의의 명확성의 요청에 따라 형사처벌되는 금지행위의 유형을 아동복지법에 더욱 구체적으로 설정할 필요가 있다. 이를 위하여 아동복지법상 방임행위의 ‘기본적 보호･양육･치료 및 교육’이 무엇인지 시행령이나 시행규칙에 명시하여 보호, 양육, 치료 그리고 교육의 유형별로 구체적으로 어떠한 행위가 포함되는지를 제시하여야 한다. 또한 ‘기본적’ 보호･양육･치료 및 교육에서 어느 정도가 ‘기본적’인지 구체적 방임행위와 장소 그리고 아동의 연령에 따라 정확한 기준을 제시하는 것이 필요하다. 그리고 현행 아동복지법의 금지행위들의 형벌을 감소하고 행위유형에 따라 다양한 형벌을 적용할 필요가 있다. 징역과 벌금 이외에 사안이 경미할 경우에는 과태료의 부과도 고려하여야 할 필요가 있다. 방임의 위험을 판단하거나 아동의 방임상태를 정확하게 판별할 수 있는 표준화된 매뉴얼을 개발하여야 한다. 그리고 아동방임 판단기준과 개입기준을 시민과 학자 그리고 실무가들의 충분한 논의를 거쳐 마련하여 학대로 인하여 위기에 처한 아동들을 보호하여야 할 것이다.
Abstract
The regulations for child neglect of the Child Welfare Law is too abstract. Even if there are suspected cases of child neglect, judicial police management and child workers are having difficulty discriminating between cases of child neglect. As a result, it not only fails to effectively protect neglected children, but also makes it difficult to prevent and cope with child neglect. In order to solve this problem, it is necessary to more specifically define the types of prohibited acts punishable by criminal punishment in accordance with the clarity of the criminal statutory state. To this end, it is necessary to specify in the Enforcement Ordinance or the Enforcement Regulations what kind of basic protection, child care, treatment and education. It is also necessary to reduce the penalties for the prohibited acts of the current Child Welfare Act and apply various penalties according to the type of behavior. In addition to imprisonment and fines, it is also necessary to consider imposing penalties if the matter is minor. Standardized manuals should be developed to judge the risk of neglect or accurately determine the state of neglect of the child.
