금융기관 퇴임 임직원 제재제도의 문제점과 개선방안

The financial supervisory agency notifies the details of sanctions that a retired executives and employees of a financial institution would have received if they were in office, and restricts the appointment as an executive of a financial institution for a certain period of time. These restrictions on the qualifications of retired executives and employees are scattered in accordance with individual financial-related laws and regulations, and a unified discipline system has not been established due to different contents and procedures. Accordingly, systematic legislation is required in relation to the authority and procedures for sanctions against retired executives and employees. In order to solve these problems, this paper reviewed the current status, problems, and improvement measures of the system of sanctions for retired executives or employees of financial institutions. Specifically, it was suggested that the system for restricting the qualifications of retired executives or employees should be expanded to all financial institutions, reorganized to ensure consistent regulation for those subject to sanctions, and the authority and procedures for sanctions should be clearly established. Furthermore, it was emphasized that it is necessary to secure the effectiveness of financial supervision by limiting the retirement of those who are expected to be severely punished in order to fundamentally resolve the voluntary retirement of executives and employees who are expected to be subject to disciplinary action.
