초록
미국에서는 1990년대에 두 번째 부/모의 입양을 두고 많은 논란이 있었다. 이것은 동성혼이 법률상 인정되고 나서 특히 부각되었고, 현재는 거의 모든 주에서 이 문제를 입법적으로 해결하고 있다. 즉, 동성혼의 경우에 친권자인 일방 파트너의 자녀를 타방 파트너가 입양하는 때에 법률상 친권자의 친권(parental rights)은 법원의 선고에 의해 소멸하게 되고 대신에 입양을 하는 사람이 친권자가 되는 문제에서, 자녀의 최선의 복리원칙을 실현하기 위해 자녀의 친권자의 친권을 소멸시키지 않고도 입양이 가능하도록 하여 자녀가 두 명의 친권자인 부/모에게서 부양을 받을 수 있도록 한 것이다. 본문에서 기술하는 바와 같이 입양은 보통법(common law)의 산물이 아니라 실정법의 산물이므로 이 문제는 입법적으로 해결되어야 하므로 입법부의 결정을 기다려야 하지만, 미국의 주 법원들은 두 번째 부/모 입양의 경우와 유사한 계부모입양의 경우에는 친생모의 친권을 상실시키지 않고도 입양이 가능하도록 하는 예외를 두고 있는 것을 근거로, 아동의 최선의 복리 원칙의 실현을 위해서 계부모 입양에 관한 입법부의 입법의도를 넓게 해석하여 두 번째 부/모 입양에 유추적용함으로써 이 문제를 해결하였다. 계부모입양뿐만 아니라 언젠가는 닥치게 될 동성혼의 경우에 입양법의 전면에 부각될 두 번째 부/모 입양의 경우도 우리법에서는 친권의 상실 없이 입양이 가능한 경우를 언급하고 있지 않다. 그렇다면 아동의 최선의 복리원칙의 구현이라는 관점에서 미국에서의 논의와 실정법적 해결이 있기까지 법원의 노력은, 계약형입양에도 법원의 개입을 인정하면서 아동의 복리를 실현하고자 하는 우리나라의 입양법에도 해결책을 제공할 수 있을 것이다.
Abstract
In the United States, there was a lot of controversy over the second parent adoption in the 1990s. This was particularly highlighted after same-sex marriage was recognized by law, and now almost every state is legislatively addressing the issue. In the case of same-sex marriage, when the one partner adopts the child of the other partner, the parental rights of the parent are extinguished by the court's ruling. For the best interests of the child, however, the adoption can be made without extinguishing the child's parental rights. As described the article, adoption is not a product of a common law, but a product of the State law, so the regulation of the second parent adoption should be made by the legislature. But U.S. courts have solved this problem by broadly interpreting the legislative intentions of the adoption law to realize the best interests of the child rule. From the perspective of implementing the best interests of the child rule, I would like to focus on the court's efforts before the discussions and the legislative solutions are made in the United States.
