특별지방행정기관에 관한 법적 연구 - 지방중소벤처기업청의 제도 개선방안을 중심으로 -

초록
본 연구는 지역중소기업의 육성 및 혁신촉진을 위한 특별지방행정기관으로서 중소벤처기업부 지방중소벤처기업청의 역할과 기능에 대한 개선방안을 제시하였다. 즉, 특별지방행정기관이라는 조직 특성과 함께 지역중소기업 지원기관이라는 두 가지 기관 정체성의 차원에서, 수요자 중심 지원체계와 효율적인 지방청 기능 및 전문성 제고를 위한 지방중기청 역할 재정립 방안을 모색함을 목적으로 한다. 이를 위해 본 연구는 중앙부처의 지역적 차원에서의 서비스 제공 등 주요 업무 수행 거점 역할을 하고 있는 특별지방행정기관이라는 조직적 형태에 착안하여, 타부처 특행기관과의 비교 분석을 통해 지방중기청의 핵심기능을 도출하고 있다. 나아가 기존 제도개선을 위해 변화하는 환경에 부합하는 지방중기청 기능 재정립 방안을 제안하였다. 구체적으로, 본 연구에서는 먼저 문헌연구와 사례 비교 분석을 통해 특별행정기관의 개념, 법적 성질 및 기능을 토대로 지방중기청과 타부처 특별행정기관과의 조직 현황 및 기능을 비교 분석하였다. 특별히 지방 노동청, 지방국토청, 지방해양수산청 등 지방중기청과 역할ㆍ기능이 유사한 타부처 특별행정기관과 역할 및 기능을 직제시행규칙 별표에 수록된 지방청 편제에 근거하여 비교분석하였다. 그리고 이를 토대로 특행기관의 성격 및 정책환경과 정책수요 등을 고려하여 타부처 특행기관과 차별화된 지방중소벤처기업청의 핵심기능을 도출하였다.
Abstract
This study suggests ways to improve the role and function of the Ministry of SMEs and Startups' Local SME Agency as a special local administrative agency for fostering local SMEs and promoting innovation. In other words, it aims to explore ways to redefine the role of the local SME agency in terms of its two institutional identities as a special local administrative agency and a local SME support agency to provide a demand-driven support system and efficient local agency functions and expertise. To this end, this study draws out the core functions of the special local administrative agency through a comparative analysis with other special agencies based on the organizational form of the agencies, which serves as a base for performing major tasks such as providing services at the local level of the central government. Furthermore, to improve the existing system, the study proposes a plan to reorganize the functions of local medium-term development agencies to meet the changing environment in South Korea.
