ESG환경에서의 공급망 실사법

Under the ESG management environment, movements related to specific supply chain due diligence laws are active overseas. Among them, from January 1, 2023, Germany came into effect with the Act on Due Diligence in the Supply Chain on Human Rights and the Environment(Lieferketten- Sorgfaltspflichten-Gesetz). While the world is paying attention to the above law, the EU Parliament also adopted a resolution that includes a directive on corporate sustainability due diligence in March 2021, and prepared a law that mandates ESG management in the global supply chain on February 23, 2022. The Korean government announced the K-ESG guidelines to respond to supply chain due diligence in December 2022, but practical measures are insufficient. This article looks at the current status of overseas supply chain due diligence laws, focusing on the French and German laws that are specifically prepared and implemented. In our case, there are no specific ESG-related bills, but the ‘Basic Act on Support for Stabilization of Supply Chains for Economic Security’ and ‘Basic Act on Human Rights Policy’ currently pending in the National Assembly for the preparation of the Supply Chain Due Diligence Act and the current law, ‘Act on the promotion of mutually beneficial cooperation between large enterprises and small and medium enterprises’ and consider its plans.
