독일 아동옴부즈퍼슨의 법적 지원에 관한 연구

The study evaluated the operation of the child ombudsperson system as well as the revision of the German Child and Youth Support Act and the establishment of a legal system for legal support for children and ombudsperson in Germany. Germany strengthened children’s rights to participation, information, advice, and counseling on June 10, 2021, with the establishment of the child ombudsperson, an independent spokesperson for children. The issue of the child ombudsperson system is to have legal authority, and the amended Child and Youth Support Act guarantees independence in terms of organization and function. First, the organization’s independence is not compromised by directives from the federal state cabinet or the Youth Administration. The independence of the children’s ombudsperson is protected in both full-time and honorary positions. Second, functional independence is ensured. It ensures the children’s ombudsperson’s expertise, autonomy, and decision-making power. Article 9a of the Child and Youth Support Act stipulates the child ombudsperson and office system, which includes children, adolescents, and families, and represents the child’s position when conflicts arise with public services, particularly the Youth Agency, as well as the authority and role of independent functions such as counseling and conflict resolution. The reform of the German Child and Youth Support Act, as well as the establishment of a legal system for legal support for children and ombudsperson in Germany, were evaluated in this study, as was the operation of the child ombudsperson system. Based on the findings of this research, we seek to draw implications for Korea, which is in the early stages of developing a child ombudsperson system.
