특허 심사청구와 라이센싱 시기 간의 관계에 관한 연구

기술 라이센싱의 지연을 해소하는 데에 있어 등록 특허의 역할을 강조하는 선행 연구들은 기술 공급자가 빠른 특허 등록을 희망함을 주장하지만, 이 주장에는 출원인이 특허의 등록 심사 시기를 선택할 수 있는 특허 심사청구 제도와 맞지 않는 부분이 있다. 본 연구는 기술 공급자의 특허 심사청구 지연으로 확보된 시간적 여유가 기술 공급자의 추정 기술 가치와 시장이 산정할 기술 가치의 간극 해소와 기술 사업화 방향에 관한 내부 이견 조율에 활용될 수 있기 때문에 이른 시기의 라이센싱 체결로 이어짐을 주장한다. 그리고 이러한 주장을 뒷받침하는 조절변수로 특허의 유관 기술 분야 수와 기업 출원을 제시한다. 본 연구는 2000∼2021년에 전용실시권이 체결된 2019년 이전 등록 특허들을 대상으로 실증 분석을 진행하였다. 분석 결과에서 특허 출원 후 심사청구까지의 기간과 특허 등록 후 전용실시권 계약까지 소요된 기간 간에 부의 관계가 있음을 발견했다. 그리고 특허의 기술 분야 수가 증가하거나 기업이 출원한 특허일 때 심사청구 지연 기간과 전용실시권 체결 기간 간의 부의 관계는 강화되는 것으로 나타났다.
Abstract
It has been argued that granted patents may resolve the systematic delays in technology licensing. However, existing studies did not consider patent examination requests that applicants can choose during patent grant examination processes. This study suggests that patent examination requests are likely to accelerate technology licensing as they may reduce a gap between technology value assumed by technology providers and one assessed by markets and contribute to reconciling stakeholders’ differing views on the directions of technology commercialization. And these arguments imply the moderating effects of the number of technical fields of patents and corporate application. Empirical analysis was conducted on patents granted before 2019 for which exclusive licenses had been signed between 2000 and 2021. The findings showed that the delay period from patent application to request for examination is negatively related to the period from patent grant to exclusive license agreement. In addition, as the numbers of technical fields related to licensed patents increases or when applicants include a firm, the negative relationship between the delay period of patent examination request and the period of exclusive license agreement is strengthened.
