치매노인의 자기결정권 보장-의사결정 지원과 돌봄의 연계적 고찰-

This article argued that decision-making support should be provided from a linked perspective with care to ensure the right to self-determination of the elderly with dementia, and tried to specify decision-making support in consideration of the characteristics and living areas of the elderly with dementia. For this purpose, the characteristics of dementia, vulnerability of the elderly with dementia, and decision-making problems were first reviewed, and theories and related legislation on the right to self-determination and the right to demand decision-making support were analyzed (II). Due to the nature of the disease, the elderly with dementia have needs not only for medical care or care but also for decision-making support, and are already incorporated into public care systems such as long-term care insurance and customized care. Since decision-making support should eventually be embodied in law and seek harmony with related systems, it is necessary to strengthen the legal meaning of decision-making support for the elderly with dementia in connection with care already established as a universal system under the current law. From this point of view, the correlation between care and decision-making support was argued and the significance of care was theoretically introduced (III). Finally, while suggesting ways to support decision-making and components of decision-making support within the current care system, the guarantee of the right to self-determination of the elderly with dementia was specified (IV).
