이동형 모빌리티의 영상․음성 개인정보 취득의 공법적 논의

기술의 발전을 통해 드론, 자율주행자동차 등 새로운 유형의 촬영 기기가 등장하였다. 이러한 기술 발전은 국가 경쟁력을 강화하는 요인이 될 수 있으나, 개인정보의 침해라는문제를 발생시키기도 한다. 이로 인해 최근 「개인정보 보호법」이 전면 개정되었으며, 2023년 9월에 시행될 예정이다. 본 연구에서는 개정된 「개인정보 보호법」의 여러 내용중 이동형 모빌리티의 운영 기준과 관련하여 발생할 수 있는 주요 쟁점을 파악하고, 관련 국외 법제도를 분석하는 데 목적이 있다. 본 연구에서는 ‘개인정보의 범위’, ‘취득 개인정보의 활용 범위’, ‘기타 취득 정보의 활용 가능성’, ‘데이터 활용 과정에서 발생한 피해 관련’의 4가지로 법적 쟁점을 범주화하였다. 국내 주요 쟁점과 국외 법제도를 종합한결과, 구체적인 개인정보 정의 및 범위를 마련할 필요가 있다는 점, 현재 관련 산업 발전이 진행 중이라는 점에서 현실에서의 법 조문 적용을 위해 구체적인 지침, 사례 등을마련할 필요가 있다는 점을 확인할 수 있었다. 특히 국외 사례를 통해 현장에서의 기술발전을 위한 정보 사용 가능성을 높이기 위해서 개인정보가 무엇인지에 대한 하나의 명제로서의 기준이 필요함을 확인할 수 있었다. 또한 예외 사항 등 참고 가능한 여러 사례를 제시함으로써 향후 이동형 모빌리티를 활용한 영상 정보를 더욱 발전적이고 안전한방향으로의 활용할 수 있는 법적 근거를 마련할 필요가 있음을 확인할 수 있었다.
Abstract
Through the development of technology, new types of devices such as drones and self-driving cars have emerged. Such technological development can be a factor in strengthening national competitiveness, but it also creates a problem of personal information infringement. As a result, the 「Personal Information Protection Act」 was recently completely revised, and it is scheduled to take effect in September 2023. The purpose of this study is to identify major issues that may arise in relation to the operating standards of mobile mobility among the various contents of the revised 「Personal Information Protection Act」, and to analyze related foreign legal systems. In this study, legal issues were categorized into four categories: ‘scope of personal information’, ‘scope of use of acquired personal information’, ‘availability of other acquired information’, and ‘related to damages incurred in the process of using data’. As a result of synthesizing major issues in Korea and foreign legal systems, it was confirmed that specific guidelines and examples are needed to apply the legal provisions in reality, given that specific personal information definitions and scopes are prepared, and related industrial development is currently needed. In particular, through foreign cases, it was confirmed that a criterion as a proposition about what personal information is is necessary to increase the possibility of using information for technological development in the field. In addition, by presenting several cases that can be referred to, such as exceptions, it was confirmed that there is a need to prepare a legal basis for using video information using mobile mobility in a more advanced and safe direction in the future.
