일・생활 균형을 위한 재택근무 도입방안 연구 - 프랑스 사례 연구를 중심으로

이 글에서는 우리나라와 마찬가지로 코로나바이러스 확산 방지 대책으로서 재택근무를 시행한 프랑스 사례를 바탕으로, 일・생활 균형을 위한 새로운대안으로서 재택근무를 도입을 위해서 고려해야 할 점을 함께 살펴보았다. 상황은 비슷했지만, 우리와 가장 큰 다른 점은 프랑스 정부는 재택근무가 근로자 개인에게 미치는 영향에 관한 논의에 주목하였다는 점이다. 특히 재택근무 시행과 함께 나타나는 부작용, 특히 근로자의 정신건강 문제와 장시간근로와 같은 문제 등 다양한 연구조사 결과에 대하여 프랑스 정부는 민감하게 반응하고 그에 맞는 적절한 조치를 취하려고 노력하였다. 이러한 모습과함께, 이미 국내법으로 재택근무 관련 규정을 마련하고 있는 것 또한 우리가나아가야 할 방향을 보여주고 있다고 생각한다. 근로자의 자율성 및 유연성 향상으로 인해 누릴 수 있는 재택근무의 다양한 장점들을 잘 활용하기 위해서는 이를 보장해줄 수 있는 기준이 필요하다. 예전부터 재택근무에 관한 법제도 마련 필요성은 이미 많은 선행연구를 통해 지속적으로 제기되어 왔으며, 보호 방식은 어느 정도 차이가 있지만, 모두 재택근무를 수행하는 근로자에 대한 노동법적 보호 필요성을 인정하고있다. 우리나라도 단지 일회성에 그치는 지침에서만 그칠 것이 아니라, 장기적인 관점에서 일・생활 균형을 위한 대안으로서의 재택근무를 고민하고, 그에 대한 보호책이 체계적으로 마련되어야 할 때이다.
Abstract
The coronavirus crisis was not a one-off and a future pandemic could emerge at any time, and the need for legislation on teleworking (i.e. working from home) is all the more critical as the trend towards more diversified working practices is already underway. Telecommuting, which was hastily introduced and implemented by the government in response to the coronavirus outbreak, has so far shown its potential as a survival method and has become an alternative in times of crisis, and it is now necessary to explore telecommuting as a way to improve workers’ work-life balance based on experiences from the recent past. Starting with the European Framework Convention on Telework in 2002, a full-fledged guideline for telework, and the National Industrial Agreement (ANI) between labor and management on July 19, 2005, the French Labor Code (Code du travail ) further sets out regulations on telework. In addition, at the end of March 2020, about 40% of all wage earners began to work from home after the declaration of a movement restriction order that prohibited all citizens from going out, and research on the impact of telework on workers has been actively conducted. In addition to the various positive effects of telecommuting, such as shorter commutes, more flexible working hours, and increased labor productivity, previous research has also identified negative effects of telecommuting experienced during the pandemic. In this article, we look at the case of France, which implemented telecommuting as a measure to prevent the spread of the coronavirus, and factors to consider when adopting telecommuting as a new alternative for work-family balance. While the circumstances were similar to those in Korea, the main difference was that the French government paid attention to the debate on the impact of teleworking on individual workers. In particular, the French government was sensitive to the findings of various studies on the adverse effects of teleworking, such as mental health issues and long working h2reased worker autonomy and flexibility. The need for legislation on telecommuting has been called for in many previous studies. Although the protection methods differ to some extent, they all acknowledge the need for labor law protection for workers who work from home. It is time for Korea to consider telecommuting as a work-life balance measure from a long-term perspective and to provide systematic protection for it, rather than a mere one-off guideline.
