외국자본에 의한 북한 토지, 주택개발 실태 -토지이용권제도를 중심으로-

이 연구는 북한이 외국인투자 유치를 위해 도입한 토지이용권제도를 통해 외국자본에 의한 북한 토지, 주택개발 실태를 고찰하고자 하였다. 토지이용권제도는 도입 이후 30여 년이 흘렀다. 2000년대 이후 북한에 투자한 외국투자자의 토지이용권제도가 어떻게 적용되고 있는지, 실태조사 결과는 다음과 같다. 첫째, 토지임대제도가 규정과 다르게 적용되고 있는 부분들이 있지만, 계약과 관련된 절차는 어느 정도 작동하고 있었다. 둘째, 북한의 살림집 공급주체 변화가 나타나고 있었다. 건설자본이 부족한 상태에서 지방정부가 토지이용권을 출자하여 외국투자자와 합영기업을 만들어 공급함으로써 주택부족문제를 해결하고, 정부의 주택공급 기능도 유지할 수 있었다. 셋째, 주택건설사업에서 외국자본을 활용하고자 할 경우에는 토지이용권제도보다는 다른 대안을 모색할 필요가 있다. 토지이용권제도는 외국투자자가 안정적이고 지속적으로 기업활동을 할 수 있도록 하는 측면이 있으므로 단기에 사업이 종료되는 주택건설과 공급에는 부적합할 수도 있다.
Abstract
This study attempted to examine the status of North Korean land and housing development by foreign capital through the Land Use Right System(LURS) introduced by North Korea to attract foreign investment. More than 30 years have passed since the introduction of the LURS. The results of the survey are as follows on how the LURS of foreign investors who have invested in North Korea since the 2000s has been applied. First, there are parts where the land lease system is applied differently from the regulations, but the procedures related to the contract were working to some extent. Second, there was a change in North Korea’s suppliers of households. In the absence of construction capital, local governments were able to handle the housing shortage problem and maintain the government’s responsibility as housing supplier by investing land use rights in the joint ventures with foreign companies. Third, in the case of utilizing foreign capital in housing construction projects, it is necessary to seek alternatives rather than the LURS. The LURS would be designed for foreign investors to engage in stable business activities for long time, so it may not be suitable for housing construction and supply projects that wrap up in a short period.
