초록
본고는 농지법상 농지취득자격증명 발급제도의 구체적 적용·운영에서 발견되는 문제점과 부작용을 조사·연구하여 적절한 개선 및 시급한 개정을 촉구한다. 우선 농지법상 기본규정을 살펴보고, 그 위임에 근거한 시행령 및 시행규칙의 규정이 정당한 위임근거를 가지고 적정한 위임범위를 지키는지 검토한다. 특히 일선 농지행정 담당자들의 행정편의를 위한 내부지침으로 마련된 농림축산식품부 예규 제59호 “농지취득자격증명발급심사요령”의 위법부당성을 중점 분석·정리해 발표함이 본고의 주된 연구목적이다. 제1장 머리글에 이어, 제2장에서는 농지법의 배경과 농지소유 제한 및 농취증 발급 관행을 대강 살펴본다. 제3장은 논의의 구체성과 이해의 편의를 위하여 개별 구체적 사례를 들어 탐구한다. 최근에 논란의 여지가 많은 ‘대법원 2021. 8. 19. 선고 2020두30665 판결’ 사례의 사실관계를 소개하고, 이 사례에서 농취증 미발급 처분의 위법부당성을 지적한다. 제4장은 본고의 핵심 주제로서, 농취증발급심사요령의 위법성과 법적 효력을 집중 탐구한다. 첫째로, 시행령과 시행규칙 및 훈령·예규 등의 위임근거와 법적 효력을 살펴본다. 둘째로, 훈령·예규의 법규범적 효력에 관한 판례의 일관된 입장을 검토한다. 셋째, 행정기본법상 훈령·예규의 법규범적 효력을 분석 비평한다. 넷째, 농지법상 농가주택 부지용 농지전용 규정과 관련한 대통령령의 효력에 관하여 중요한 대법원 선례를 소개하고 검토한다. ‘대법원 2000. 10. 19. 선고 98두6265 전원합의체 판결’로서 농지전용불허처분취소 건인데, 농지법의 위임범위를 초과한 시행령 규정의 무효를 전원일치로 확인했다. 다섯째, 농취증 신청 및 발급절차에 관한 농지법과 시행령의 위임근거 및 위임범위를 각각 차례로 살펴보고, 부령(部令)인 농지법시행규칙의 수임입법 규정도 함께 분석·검토한다. 여섯째, 시행규칙 아래에 농지행정 실무자를 위한 예규인 농취증발급심사요령의 위법 무효를 논증한다. 특히 ‘심사요령’ 제9조 제3항은 법·령·규칙 체계상 위임근거가 없어 당연 무효이고, 제9조 제3항 본문과 제3항 제4호 내용 사이에는 모순이 존재하며, 실질 내용도 위법·부당함을 밝힌다. 제5장은 맺음말로서, 본고의 입장을 요약하고 개선 및 개정을 촉구한다.
Abstract
The Farmland Act establishes some legitimate restrictions in order to realize the constitutional principle of tillage fields, secure farmland preservation and efficient use management, and prevent illegal dumping on farmland. The system of issuance of Qualification Certificates for Acquisition of Farmland(QCAF) was introduced for the purpose of pre-monitoring, managing, and supervising whether these reasonable regulations under the Farmland Act work properly in reality of farmland transactions. “Examination Guidelines for Issuance of Qualification Certificates for Acquisition of Farmland” is an internal guideline prepared for the convenience of front-line administration in their specific implementation and application, but appropriate and reasonable revision is required as significant illegality is found both in the formal statutory rule system and in the actual content. Accordingly, this paper examines the basic provisions of the Farmland Act, and examines whether the provisions of the Enforcement Decree and Enforcement Rule based on the delegation have a legitimate basis for delegation and comply with the appropriate scope of delegation. In particular, the main purpose of this paper is to analyze, summarize and announce the illegality of the Ministry of Agriculture, Food and Rural Affairs Established Rule No. 59 “Examination Guidelines for Issuance of QCAF” The main contents are as follows. Following the introduction of Chapter 1, Chapter 2 briefly introduces the purpose of the Farmland Act, and outlines regulations and general practices related to farmland ownership restrictions and issuance of agricultural certificates. Chapter 3 focuses on individual specific cases for the convenience of understanding and specificity of discussion. First of all, I will introduce the case of the recent controversial ‘Supreme Court 2021. 8. 19. Sentence 2020du30665 decision’. In the case, FAQC was not issued, and I will point out the illegality of the disposition. Chapter 4, as the core topic of this paper, focuses on the illegality and legal effect of the Guidelines for Issuance of QCAF. First, the grounds for delegation and legal effect of enforcement ordinances and enforcement rules (directives, guidelines, and detailed regulations) are reviewed. Second, the consistent position of precedents regarding the legal and normative effect of directives, guidelines, and detailed regulations is reviewed. Third, this paper will analyze and criticize the legal and normative effects of the directives, guidelines, and detailed regulations in the Basic Administrative Act. Fourth, important Supreme Court precedents are introduced and reviewed regarding the effect of the Presidential Decree in relation to the regulations on the conversion of farmland for farmhouse sites under the Farmland Act. It is a case of canceling the disposition of non-conversion of farmland as ‘Supreme Court 2000. 10. 19. Sentencing 98du6265 enclave decision’, and the invalidity of the enforcement decree that exceeded the scope of delegation of the Farmland Act was unanimously confirmed. Fifth, the grounds for delegation and scope of delegation of the Farmland Act and the Enforcement Decree regarding the application and issuance of agricultural certificates are examined in turn, and the entrustment legislative provisions of the Enforcement Rules of the Farmland Act, which is a ministerial decree, are also analyzed and reviewed. Sixth, the illegality and invalidity of “Examination Guidelines for Issuance of QCAF”, which is an internal guideline for farmland administration practitioners under the Enforcement Regulations, is demonstrated. In particular, Article 9 Paragraph 3 of the Guidelines is naturally invalid as there is no basis for delegation in the system of laws, ordinances and rules, and there is a self-contradiction between the main text of Article 9 Paragraph 3 of the Guidelines and the contents of Paragraph 3, Subparagraph 4. It also reveals illegality and injustice in its actual content. Chapter 5, as a concluding remark, summarized the position of this paper and wrote the desire to urge improvement and revision.
